My fiance defaulted on a student loan. We are getting married. Can they come after my money? Once my name is changed?


It you are filing joint on taxes, they will seize both state and federal income tax returns. You can your portion returned via injured spouse paperwork but that can take time.

Since you will be married to him, you will be ineligible for FHA or VA mortgages. You will also be denied any FEMA benefits too.

Encourage him to get it resolved now, not later. It will indirectly affect you, especially if he gets denied licensing in certain professions and job and promotion loss due to not being able to pass security clearance.

Hi,
I am owing money in student loans that has now gone to collections (I am in the province of Alberta). I have not had an income greater than $12,000 canadian a year since I've been out of school so I have had no way of paying it back. I want to start a cleaning business, and would like to start making payments. If the business is registered in my name, will they be able to seize my assets or any profit made by the business or will I have the freedom to allocate a percentage of my earnings to paying them back? Do they have a right to my earnings or only my tax returns?
