question about court case/settlement

last week i got a court date for civil court for a credit card debt to capital one for about 1500.00. first thing i did was apply for a lawyer through legal aid (i got one last year when asset acceptance tried to sue me on behalf of chase for over 10,000), i was denied this time though because legal aid does not do civil cases.

i did talk to a lawyer on the phone friday who was very nice and answered a lot of my questions. he said i could call and try to settle out of court if i wanted.

monday i called and the lady i talked to was very very nice. we set up a 60 dollar a month payment plan and once it is all paid off in 2 years it will be removed from my credit report and i am supposed to get paper work in the mail with all the info and one i need to sign and send back, etc. but she did tell me that the court date can not be canceled unless i can pay the amt in full, which i can not do due to my low income.

so my question is, should i still go just to make sure everything i talked to her about on the phone is what is dicussed. she said i do not have to, but i am not sure. this is not a collection agency suing me either, it is a lawyer for the CC company.


They will still get their judgment....you have to make sure it is a conditional judgment. This allows you to get make your payments without them garnishing you or levying your bank account. However if you miss a payment, the arrangement is null and void and they will step in with further action.
