Is it possible to use my garnishment payments to help me out come tax time?


They can only garnish tax returns for money owed to the federal government. Credit cards are civil actions so they can't touch your tax return unless you go through an agency where you get an instant tax return. Since you are going through a bank they can garnish the return. I am going through the same thing and I will wait the 6-8 weeks to get my refund if it means I will get it.

so if i get the emralrald card through hr block can they still garnish my taxes even if its not instant?

The first guest is right, the only thing IRS can garnish is if what you owe is federal in nature and are already being garnished for that. I just went through this with the IRS. Since I still owed them money from a payment plan they took my tax refund. No biggie, as I still got my state refund, and it my balance went down.. so now I ownly owe two more payments if that.

They will give you notice. I owed state and they snagged part of my federal to pay it. I got a letter in the mail stating that part or all of my federal refund was being held for my state debt.

Happened two years in a row until the state was paid off. Of course the state kept all of my refund as well.
