They can only garnish tax returns for money owed to the federal

Credit cards are civil actions so they can't touch your tax return unless you go through an agency where you get an instant tax return. Since you are going through a bank they can garnish the return. I am going through the same thing and I will wait the 6-8 weeks to get my refund if it means I will get it.

The first guest is right, the only thing IRS can garnish is if what you owe is federal in nature and are already being garnished for that. I just went through this with the IRS. Since I still owed them money from a payment plan they took my tax refund. No biggie, as I still got my state refund, and it my balance went down.. so now I ownly owe two more payments if that.

Happened two years in a row until the state was paid off. Of course the state kept all of my refund as well.
