we paid our account off in 1998 they sold are name to other collections agency they asking for money

Hi Cindy

Have you pulled your latest credit report from the three bureaus? If you have paid the accounts in full to your creditors, it should not be reported to the collections. Please ask the collection agency to validate the said debt otherwise inform them that they are required to stop communication and take legal action.

i pulled the credit report one account it says paid and closed on one credit repoert the other account we have a copy of the check the orginal creditor cash we are now be sent to court from the collection agency i did send copies to the credit bureaus but the collection says they dont care it been paid in there books it is not and they want there money

Cindy - As you are having the legal proof that you have paid your debt and it is appearing in your credit report, then there is nothing to worry about it. The collection agency cannot however get the money from you by taking the matter to the court.

Aside, they will have to bear the court expenses for filing a case.

Did you compare the three credit report from each credit bureau? Each entry should appear in the same way. If you find any error, then you have the right to dispute with the agency reporting the error.

If you find any error, then you have the right to dispute with the agency reporting the error.[/quote] we have a court date on the 18 th of august for this matter i am dispute to the credit bureau now about it they are not on 3 are the same taking our paperwork with us to court cancell checks and bank settlement sheet they were bank checks from a home equity loan

If the entries are not appearing the same in all the three credit reports, then you can dispute it with the agency and highlight the portion which is in error.

Also, if the collection agency is claiming for the debt, ask them to validate it first. They must furnish all the details about your account

ask them several times to validate it they have not shows us paperwork on it they agree we made a payment on it be they said it is in the discovery stages with them they say we owe them 1400 and on our credit report it shows 5000 dollars is going to court on the 18 th enough paperwork to show we paid will favor us . what is your opinion do you think we will win

Make sure that you appear in the court. If you are not present, the other party will assume that you are guilty and consider the claim legal. So your presence in the court really matters.

In your credit report, the debt is $5000 and the collection agency claims $1400 for the same debt. I guess there is a huge mistake with either of them. Did you dispute with the credit bureau?

Did you dispute with the credit bureau?[/quote] we miss the fist court date because my father had a heart attack we had to leave to go to illinis we are are going now to set side the judgement default we will show up for this one yes iam in dispute with the credit bureau now

cindy - If the creditor has been paid by a debtor and still issues a judgment, then "MOTION TO VACATE" can be filed with the help of the attorney.

The attorney will file a motion of Service of Process for the purpose of having a damaging judgment entry removed from the credit file

By filing a motion of service of Process, the creditor has to appear in the court with an attorney and prove that the initial legal process was done by him properly. This legal maneuver works in your favor because if the creditor has been paid, then he will not appear in the court knowing the value of the time and money.

In such case, you will win the judgment as the creditor didn't appear in the court and the damaging judgment information will be removed from your credit file.

There are cases where consumers usually win the judgments by defaults.

contact a attoney he said i was on my own on this one we paid the orginal creditor but the collection said they didnt care they bought our name and needs to collect on sent him all the paperwork going to court miss the first one my dad had hard attack that same morning we filed a court date for june 2 the collection ask for exection on till august 18 court date we are represting our self any advice

If they refuse to validate the debt and still keep calling you, then you have the right to take legal action of not validating the said debt and continue calling you under Consumer Protection afforded by the fdcpa Section 805(c) and sue them up to $1000

Received a marketing letter saying we had funded a home loan with Transamerica. Wrong! Never heard of them-- have learned they were bought by GE Commercial Dist. Finance who are no hrlp. Any info or advice??

I just got a copy of my free credit report which listed a revolving credit account with your bank dated from 1997. I cannot recall this account or why it should still be open. Please check on this and get back with me.

I contacted the above number (847) 747-7229 which directed me to call (847) 747-6800. A real person answered and directed me to TA which is not in business right now but have staff for this kind of issue. The number(s) to call is 1-847-230-1111(1137, or 1138). They were more thank helpful.
