Dear frogpatch,
Except for 8, 9, and 10 I have been a customer paying off loans for more than 5 yrs. with the follwing Pdl's;
1. Quick Cash
I owe them 925.00 for 750.00 loan
2. Fast Bucks
I owe them 1225.00 for a 1000.00 loan
3. Cash America
I owe them 1100.00 for a 840.00 loan
4. Ace Cash Express
I owe 1200.00 for a 1000.00 loan
5.Check n Go
I owe them 1100.00
for an 800.00 loan
6. Fast Cash Now
I owe them 600.00 for a 500.00
7.Quick Cash
I owe them 1200.00 for a 1000.00 loan
8. Cash Advance America
I owe them 840.0 for a 700.00 loan
9.Dash for Cash 625.00
I owe them 625.00 for a 500.00 loan
10.Cash Net Usa
I owe them 400.00
for a 350.00 loan
Sorry Itook so long to answer. Are Texas laws for Pdl's in my favor ?


Here is the link to your state's pdl laws. TX does allow criminal prosecution if the account is closed by the consumer. But they have to prove criminal intent. As far as the internet pdls you can file complaints with your AG's office and deal with them with complaints and fight them in that manner as they are not licensed, that is what is not in their favor. As far as the storefront pdls, you need to work out a repayment agreement with them and stick to it, they are licensed.

Like I said, you need to research TX pdl laws, because the DO ALLOW for criminal prosecution if you close your account. It does not say it in the link, but I have RESEARCHED that fact and they will prosecute you if you close that account, you have storefront pdls out.

It does not matter what they say you owe, I would like to know the amounts that you have already paid them. If you close your account they will not be able to prove criminal intent if you have been paying them for years. Please post those amounts and we will try to put an end to this. Maybe you can even get a refund from one or two if you pressure them enough.

Be careful about saying that Frog, TX has prosecuted people in the past for closing accounts with an outstanding storefront. I do not advise closing that account until you speak with somebody in your state. Other states operate differently, TX is one that will allow a prosecution and the storefronts do utilize that option.

Ecl, Im sure this is getting a bit confusing for u as the law is VERY confusing! (my daughter is in pre-law school right now and is struggling with how difficult it is to interpret the law) Anyway, Maybe try to PM texaslawyer and ask him! I'd imagine he knows the laws in his state! :)

I am telling you guys, to tell this person not to worry about criminal prosecution is TX is giving false hope and not accurate. They need to be aware that closing their account can lead to prosecution, there have plenty who have come here to testify to the fact that they were prosecuted for closing their account. Like I said, you need to contact somebody from your state to get more clarification.

If I walk into a storefront and take a loan and then close my account that is theft against a company located in Texas and I am going to jail. If I have a company that has illegally charged me over the limit of the state usury laws over the internet I am protecting myself from theft. Criminal intent is just that. Intent. You must have taken the loans with the intention of never paying or deliberately paying less than you borrowed. No prosecutor in his right mind would prosecute that. Not if I have a record of consistently paying especially. But Eclesia hasn't said how much was paid yet. She may have to send aa ACH revocation to the new ones and try to make arrangments with them if they refuse then they are in violation of the law. But the letter proves there is no criminal intent. At least that is my opinion.

But not only does this person have ipdls they have also listed licensed storefronts, they need to be careful and seek advice by calling somebody in there state who knows the law regarding this matter before closing any checking account. I for one don't want to be the one to tell them to go ahead and close the account, I'm not the one facing potential legal issues by saying that, they are. They have listed licensed storefronts, and one licensed ipdl, CashNetUSA.

I am NOT arguing that point with u Hardcore!! That is EXACTLY why i suggested PM'ing texaslawyer to this person!!! Or as u suggested contact someone from TX!
I NEVER told this person not to worry about anything! Only suggested to find out for sure.... so ElPaso plz as suggested either and/or pm texaslawyer and call to speak to someone in ur state to cover ur a..

Excuse, me, I was not arguing, here we go, I make a statement and because I am HARDCORE you want to assume it is an arguement. They NEED to contact somebody in their state and not rely on legal advice on a forum, that is the best advice one can give them. You are making this confrontational. I am not. CashNetUSA is licensed ipdl also. They typically do not prosecute, an agreement needs to be worked out with them, they rent the license of pawn shops in the state's they loan to they is how they are in business. Get agreements in place with the licensed storefront and ipdl, you will rest easier. Unlicensed ipdls really do not have a leg to stand on and they know it.

Here is my suggestion. MY GOD 5 years. Contact the Attoney General ASAP. Their number is 800-621-0508. This is the consumer division. No one knows the laws better than these folks. They are there to protect the public from people like this. I am so sorry that this has been going on for so long. Give them a call. KYSIDE38
