Student Loan Garnishment/Abuse


I recently contacted the collection agency (ATI) to make arrangements to start making payments on my outstanding, defaulted loan.

I'm finally working again after a long unemployed spell, and wanted to try and get things right.

After a million questions over the phone they finally asked me for 3 'references'. Or as we all know, 3 people they'll call if for some reason I don't answer my phone. Well I offered them my Mother as a contact. But I have no other family at all. And I am not comfortable giving out the personal information of friends or acquaintances.

I politely and calmly explained this to them and got told sternly, "then you can make any deals with us!" I was transferred to a manager and she was even more unpleasant.

Anyway I continued to offer them the one reference and monthly payments and they refused instead planning to garnish my wages.
Is this right? Can I do anything about this?
I was offereing a payment plan that was much bigger than any garnishment they can take. And I'd like to pay this debt off quicker.

Can they really demand that I give out the personal information of 3 people that have nothing to do with my debt?

Every CA is REQUIRED to update the reference file which means getting new or updated references. You listed them on your original prom note....they are probably not any good any longer.

They do not call the references unless A) your phone is disconnected or B) your mail is returned.
