can anyone tell me what exactly the brunner test is when considering discharge in bk? is there a site that explains it better? also, has anyone had student loans discharged in bk?


For the brunner test you have to meet all three conditions. It is very rare to have one discharged.

(1) that the debtor cannot maintain, based on current income and expenses, a "minimal" standard of living for herself and her dependents if forced to repay the loans;

(2) that additional circumstances exist indicating that this state of affairs is likely to persist for a significant portion of the repayment period of the student loans
(they will look at the next 25 years)

(3) that the debtor has made good faith efforts to repay the loans. (usually over a 5-7 year period of repayment)
