Total and Permanent Disability


I am a disabled Vet. West Asst, management has garnished my small disability check for a Sallie Mae Student Loan. I have sent them proof and verification over and over, they always respond with reasons they cant accept my paper work. I recently sent them a copy of (not my 100% disability), but a letter stating that I am 100% unemployable. Under section II, item three of the Disability Discharge Application, there is no other supporting documentation required with Unemployability, but yet it seems they are more concerned with collecting money than helping. The small amount of money they are garnishing from my disability has totally killed me. I am left with little choice, financially I am finished and my life is currently a slow miserable death. They wouldn't provide me with their pysical address, but through the internet I have been able to find it. Maybe the need to see what they are doing to people, perhaps they need to see someone walk into their office and see them blow their brains out, to end the pain. And just may be if their feeling lucky someone should just open up and take a few of those thoughtless selfish ...... out too

West Asset is not garnishing you nor are they making the decision on your disability. Guaranishments are submitted by your guarantor and they make the decision on your disability based on department of education guidelines.

Permanant disability is very difficult to qualify for. Your disability cannot pre-date the loan. You might be unemployable at your previous profession but can you work at another job? You basically have to be in a position where your condition will never improve, cannot be controlled by meds and will never work at any job again ever. It is tough to meet these qualifications and you must submit exactly what they ask for.

In part you are correct, but lets start with the disability. I am 100% Pemanently and Totally disabled and also deemed as 100% Unemployable, all of which is and has been documented. Please believe me there is nothing I would want more is to wake up each and every morning and have to go to work, being stuck at home isn't a life for anyone, a lot of things that we take for granted come to light when the proverbial shoe is on the other foot. Now for West Asset Management, for a while they came across that they were concerned and would do any and everything they could to help me correct a wronged situation. Everything that theys said they needed and I had to provide, I did, but there would always be a little more or something else. Then come to find out they never sent or provided any information to anyone. This was just a ploy to drag things out so they would get thier commision each and every month that went by. Then recently I went to get additional documentation and to my suprise I found someone that knew and understood the process. I am not required to provide any medical documentation from my doctors, its written in black and white that all that is required from me is the documentation from the VA. West Asset has had this information over and over again along with documentation from my doctors, so don't make it sound like they are only doing their job and being totally legit. I have no fault with the jobs they do to provide for their families provided its done honestly and correctly, but there is no dignity in lying, or robbing Peter to pay Paul.

West isnt getting a commision if you are not paying....you are dead weight in their inventory and they would be more than happy to close your account ONCE THE CLIENT says to. We used to get the permanent disabiltiy paperwork and would submit it to the guarantor...it was up to them to close the account. In the meantime, we as the CA were required by both our client and due dilience regulations to make attempts and contacts on the account.

It is still possible that you will not be discharge and couldend up with your disability being garnshed by the government.
