Ex wants to be taken off as cosigner
My ex bf co-signed a private school loan for me. When the check came and I signed it, he signed it and deposited into HIS account, and used the funds for something else. Needless to say we are no longer together. He promised to pay me back by repaying the loan. Instead he missed some payments which would prompted the loan company to send me late notices, I would call him to find out why he didnt pay. I got fed up with the crap and just decided to pay the loan off my self, which is now automatic deducted from my acct.
Now he is sending me threatening messages to take him off as a cosigner since he wants to "buy a second home". I spoke to my loan agency and they said that due to the late payments they cannot take him of as a cosigner. He is now threatening to take legal course and sue me.
My questions are:
- Can he legally sue me, even if I make on time payments & not taking him off as a co-signer
- Can he legally force me to refinance the loan (10K) when I barely make enough to pay for rent and daycare?

He is BSing you. Were he to take you to court you can tell what
He is BSing you. Were he to take you to court you can tell what happened to the judge. He is just as liable as you and in fact you should sue HIM for his using the money in a way not intended. Try telling him that you will sue him and that it might be considered fraud and theft. Besides, he has no legal leg to stand on since he co-signed and he used the money.
No he can not make you refinance. Like I said, you should not let him intimidate you.....the law is on your side in this case. YOU have a case agains't him...the fatc is he spent money so he is liable.
