Advice on Dealing with GeorgiaHiEd and CA on defaulted loan


To sum up long story I defaulted on my student loans in 1996 and as a single mom with an Autism Spectrum Child. I still remember Mrs. White from Georgia Higher Education telling me to change my taxes in way so we could live on least possible money and the tax garnishment would help. When I married in 2002, my husband had no problem letting any refund we had go to my student loans. Priemere Credit Collection has had the loan for at least 4 years now but they never respond to any written documentation, certified or otherwise. I have paid $21K in tax intercepts on my 13K loans. In February, Premiere Credit sent a statement saying I owed 953.52 with their collection fees. Our tax return was a refund of $952.

I wrote a certified letter to Georgia Higher Ed Assist Corp who receives my tax intercepts asking for the balance left on my student loans (cus I do understand the interest.) She told me she could not provide that information for me and to contact Premiere Credit. Premiere Credit only wants to yell and yell some more nad say nasty things that i wont repeat. They will not respond to written requests and two weeks ago I received 4 letters from them stating that I now owe 1403.95. I cannot get clarification if this is a new amount, or the old amount with interest.

I have not worked in over 5 years because of my son's special needs. My husband lost his job last year and we took a large pay cut which means I need to return to some type of work -but I cannot teach because Georgia will not release my certificate. Georgia says I need to make payments to Premiere Credit but they will not provide any documentation as to the amount still left.

Does anyone have any advice on where to go from here? If the IRS sends the money to Georgia and not the CA why cant GA release the amount paid/left on the loan?

Student loans as a matter of policy do not respodn to written correspondance. When an account is sent to a CA, the guarantor will not get involved...the logic being is that the CA gets a commision to work the account.

The "statement" that the CA sent you in February, it not always an accurate picture of what you owe. Since the CA does none of the calculations, the only time you will get an accurate amount is if you request a "payoff" letter from the client.

All you have to do is call and ask the CA for a "client" payment history and a "payoff" letter. If the collector gives you problems, go back thru the main switchboard and ask for a qualified manager...request names and title.
