AES duped me


I signed a promissory note with AES to consolidate two private loans. The promissory note that I signed stated a variable interest rate that is comprised of 5% + variable 3-mo LIBOR rate. Upon receiving verification that it can been consolidated, the disclosure statement declared a ra6te of 7% + variable LIBOR rate. This was not that I had signed!!!

When I called AES, I spoke to four different people about the situation. Each told me that I was stuck at that rate and that there wasnt anything that they could do.

The purpose of the consolidation was to take payments of $300/mo for 20 years and spread them over 30 years. This loan has changed my payments to $300 over 30 years!!!

AES duped me.


two questions.

1)did you keep a copy of the note you did sign
2)was there another signature on the note you signed.

before i determine anything i need answers to those two questions.

1. I kept a copy of the promissory note and the disclosure statement.
2. I was the only signature on the promissory note. No co-signer and no signer from AES.

I guess I would understand if they reject my promissory note, but then I should be able to go back to my pre-existing payments. I just cant believe they went ahead and consolidated at a different rate!

as long as you have a copy of the note you signed at 20yrs you should get a consumer attorney and sue to get the rate and years you were promised.the fact that they tried this shows me that they transposed your signature on the new agreement.that is not good for them.

If you have PROOF that you signed something that ORIGINALLY said 5% over 20 years, I think you DO have a valid case.

I have AES as my Student Loan Lender. They've been pretty good to work with. I think, legally though, they would HAVE to go by what THEY, themselves, wrote..know what I mean?
