Help me with NCO: Wage garnishment


Hello :D

Today, while I work, I got a call from NCO saying that my student loan had defaulted. Honestly, I had no idea because I paid off my school school loan and thought that everything was settled. I was wrong. I guess what happened was that there was a balance left my federal loan and after 9 years, it has grown to almost 20k.

I was at work and they kept harassing me saying that my wages will be garnished starting today if I didn't set up a payment plan. I asked them to call me tomorrow, my day off.
After talking to the manager they agreed to talk to me tomorrow.

I'm glad I stumbled upon this site. My plan of attack is to ask for a rehab program. And in the event that they say I have to put down a down payment I would reply like this. Courtousy of Soaplady.

"If they they refuse, and your budget including your other student loans wont allow it, simply tell them you will file a complaintwith the student loan ombudsman. They are going against the Higher Education Act."


Sorry for some reason my reply box kept spazzing out...

I make around 2000 after taxes a month and I can't afford to pay alot nor make a downpayment. They have already taken my tax return from a couple weeks ago. In the beginning I thought it was a mistake and was going to call about it, until they called me at work.

I pay around 1000 in rent (for me and my fiancee)
I also pay around 400 in groceries a month while paying for her tuition. I'm working and sending her to college. =]

Is this the right way to take care of the situation? I would greatly appriciate any and all help before talking to NCO again.

The last thing I need is for my wages to be garnished and force my fiancee to get loans.

The reply box is doing it again, I guess it keeps the posts from getting to long.

If they agree to let me rehab the loan, does the garnishment stop? The manager told me that if we agreed on payments the garnishment wouldn't occur.

Also, I am a waiter, so does my garnishment come off of my pay stub, or my total wages earned including tips?

For example, my paycheck is usually around a 200 dollars bi monthly, while I might pocket 800 from tips bi monthly.

I also read from another Soap post to consolidate the loans. Could I still consolidate them, even though they are defaulted and going via CA?

Ok..they wont be able garnish you....your "paycheck" wages are too low.

The CA is going to have a big problem with you supporting another adult who is not your spouse. Is this fiance working at all? They probably will not take into account her half of the rent or other expenses....so be careful.

We are set to get married in a couple weeks. I also declare that 800 in tip that I get bi monthly, so it shows up on the earnings side of my paystub. Then it gets taken out in the deductions part, leaving my paycheck just my hours minus the tax from my hours and paycheck.

So, whould I try to consolidate the loans, or ask for rehab?

i had them taken out becuase of a default loan but they are taking too much out and i am barely making 400 bi weekly and supoorting my daughter trying to pay 550 dollars a month and utilities plus grocerys i tried calling the loan company and they said that they cannot wave the garnish if they do i would have to have them debted 200 dollars from a debit account every month which i do not have. i told them i cannot afford it they taking atleast 15 percent what can i do please

A 30 day notice of garnishment would have been sent by the CA or the guarantor to the address they had on file. This letter gave you the ability to appeal the garnishment and enter into voluntary repayment. It is the borrowers responsiblity to keep the guarantor informed of their current address....many times garnshment notices are not received because of bad addresses.

FYI...your employer calculates your garnishment. It should be calculated each pay at a rate of 15% of your disposable pay.

yea i understand that but this is really cutting down my pay i should be atleast getting over 400 too 500 a pay check and i only getting 393 by weekly. also with this new obama stimulus im still not benifiting by this even though they trying to give me more in my paycheck it realldy doesnt i still get the same 393 every pay so how do i benefit from this stumulas

Maybe they changed there deductions?? Also, you may be having less taxes taken, which means your garnishment will increase. They take 15% of your disposable pay, which is your pay after mandatory deductions like taxes, fica, SSI and medical insurance.

Check with your payroll to see if they are garnishing the correct amount.
