Affraid Allied Interstate will not uphold agreement

I have made an agreement to pay off a student load. Allied agreed to settle for $1700 provided I make final payment $1450 by 3/23/07. They said they would consider the accout paid in full. However, they send me bills that reflect the amount due is $2477.65 rather than $1450.00 as agreed. I am terrified that this coming Friday I will pay the $1450 and they will disregard what was agreed to. I do not know what to do. The payment was set up as an automatic withdrawl. Another concern is I am being billed by Allied and a company called National Payment Center US Department of Education. PLEASE advise!!! It has been so hard trying to pay off a $4500 loan. To date I have paid almost $10,000 trying to get rid of principal and penalities. PLEASE HELP!!! Thank you for any advise.

Request that AI send you a settlement in full letter by fax. They will do it if requested. It will state the current balance, settled amount and the student loan guarantor. What you are getting in the mail is normal billing, outside of the settlement agreement.

Whatever you do, do not loose the settlement agreement. It is also a good idea to get a copy of the check front and back once it has cleared. AI is a DOE contractor and a settlemnt agreement letter with proof that it was paid is worth it's wait in gold.

Also since you are settling over $600, be prepared for a 1099 next year to file with your taxes.

Actually they are required to file a 1099 when it is over $600. The jd buyers and collectors having been fighting the irs on this issue for a while. They lost a federal case and now have to be brought into irs compliance.

For my proof please look up this case:
Case 1:06-cv-00101-CKK
Dba vs Snow Filed 01/19/2006 in Federal court.Located in Washington D.C. The debt buyer's association filed a complaint against secretary of treasury and commissioner of the I.r.s. This is also a good read for issues on validation.

I made a settlement agrremet with FAS Financial Asset management on which $1040.00 was to be paid on March 22,2007. The agent Mr. Brown and His supervisior Paul said I had to use a credit card. I did not have one so my brother used his. I havea fax that says a check must be sent it say this notice is to confirm the settlement agrrement of $2080.00 but does not mention the credit card payment which they charged. again it says what the fax saif (payment in the form of certified funds, cashier's check or money order.) They insisted on a credit card that day. Should I said a copy of the credit card bill?
