S.O.L on money owed to a college (not loan)


I attended a local 4 year college and something happened with the paper work and my tuition did not get applied to a loan. So therefore I had a bill for a full semester. I couldn't find funding anywhere not even thru my current bank who has all my other loans. So fast forward a few months, a collection agency got my debt and wouldn't work with me to make payments.They stated in a letter "MUST BE PAID IN FULL" I thought that was total BS until I talked to a representative from Merchantile and they said the same thing.Well fast forward almost 6 yrs, they are still trying to collect and i am not in any situation to pay it off.

My questions.. Is this debt eligible for Statue of Limitations? and if so what should i do? My last question is. Since the college sold the debt to the collection agency could i reapply to that school?
My State is New York


Your debt would not have been sold to a collection agency, only placed or assigned.

Tuition accounts, if you attended a state or non profit school have no SOL. If you attended a state school, they can have your tax return offset to pay the balance.

You cannot return until the balance if paid in full.

[COLOR=black]I attended a private university in NY and I own them a lot of money because my father promise me he was going to help me and in the end he didn't (actually I even didn't want to go to college but he pushed me to go and "promised" me he was going to "help"). Anyways since I own the debt directly to the university and my credit is crap because and I am in big debt; does anyone has any ideas of what I can possible do? I still want to go back (at a cheaper college), finish my degree and possible get a PhD (My dream was to become a researcher but I think I would have to wait or scratch that from my goals)[/COLOR]

I had to leave state university suddenly during my first semester due to emergency circumstances. I was unaware I needed to formally withdraw in order not to be charged for the semester nor did the school advise me of such when they knew I was leaving. The university charged me for the full semester. Now a collection agency is calling on behalf of the school and has added on huge interest amounts to the debt. I cannot possibly pay this as I have been unable to obtain a job in this economy. Can I file a chapter 7 bankruptcy for state university debt (not a loan) to get out from under this debt?

Did you talk to the bursers office or student accounts? Or an academic advisor. Any time you enroll in a school you agree to abide by the withdrawal policy set by the school. With a state school, you are not due any refund after about the 4th week....look up your schools website under tuition withdrawal policy. Failure to withdraw not only brings financial problems buy automatically will give you an F for each course.

State debt...no bankruptcy. Do you owe student loans as well?
