I wrote a note on the bottom of the letter they sent to me and returned it to them.

From your post, I am assuming that you admit to the debt being yours but do not want to pay what you already paid again, is that correct? If this is the case, then this is a matter of questioning the amount they claim as owed. You will need your bank records showing all the payments that they took out, plus any other payments you made. Be prepared--make three copies of this documentation.
you said that you believe they did not credit the amount you paid--can you explain why you believe this to be the case? What did Dell claim you owed back when all this began?

I do owe Dell. I truthfully don't remember the total given to me. It was all done over the phone and I received nothing documenting it. Guess that was not very smart of me. I live in Ascension Parish. If I remember correctly I was going to pay that monthly payment for 12-18 mths to pay off total owed. What makes me think that wasn't deducted is the fact that they state the date as March of 2009. I was contacted by Dell in 2010.
Why would the Citation state that date? that is not the date the account was originally setup either. Just struck me as odd.

I see what you are saying, so once you have been served a citation is it Ok to contact that group to see if they will setup payments or too late it has to go to court. When Eaton contacted me and said if I disputed it they would obtain verification or obtain a copy of a judgement and mail me a copy of such judgement or verification so I wrote back to them, please do and also something showing that Dell assigned the debt to Midland and Midland assigned it to Eaton Group, the next thing I get and a couple of months have gone by...is the citation served. I thought they would send me something to verify the amount before I got a court citation.
