Collectors are at it again!


Thought I had everything taken care of. In debt consolidation and everything was going fine until today. I received in the mail a letter from Finkelstein, Kern, Steinberg & Cunningham Attorneys at Law out of Knoxville, Tn, stating that they represent financial institutions in the area of creditors rights. They state that they are representing HSBC that has placed my account with them. It also states that at this time,. no attorney with this frim has personally reviewed the particular circumstances of the said above account. Then it says Notice: the purpose of this letter is to collect a cebt and any information obtained will be used for that and other purposes allowed by law. Now tell me why HSBC has been accepting payment plan and then turned this account over. Or has this law firm took it upon themselves to collect?

Then as I am going through the mail there is a letter from United Legal to Money Gram or Western Union my balance owed to Rio Resources. Rio Resources is a payday loan that is consolidated with Town & Country. All they sent for validation was a copy of the paperwork from Rio. They don't verify hardly any information. Eric also stated in the letter that if we pay money to Rio Resources, that it will be refused and sent back and then I would have no choice but to send United Legal Corp the payments. No way in hell am I going to send them any money. I am waiting for a call back from Town & Country on what to do. I guess you could say Merry Christmas to me. :cry: NOT :( . I hope they enjoy ruining my christmas. I am fed up with this mess. Just when it looks like we are going to get ahead and get ourselves straightened out, we get knocked down a few bricks.[color=blue][/color][color=blue][/color]

Contact the consolidation company that is handling your accounts with HSBC and ask them to solve the problem. If your creditor is getting paid for the said account, they cannot assign it to some other agency. However, sometimes creditors sell the remaining amount of the accounts that are settled to some collectors. I think your consolidator can handle the situation better. Speak to them immediately.

As per as the payday loan issue is concerned, verify with RIO whether they assigned the debt to ULC or not. Since ULC has not sent any written log of their own, but copies of original agreement papers with your lender, how can one understand that they own the account indeed? As this account is also under consolidation, contact the company that is working with you and request them to verify the matter.

Once you are under consolidation program, your consultant is supposed to negotiate with your creditors on your behalf. Do not get morose. Hope your case will be solved by your consolidation companies. Keep smiling...Merry Christmas :)

The process is very simple. If the creditors are accepting payments from you, it means that your account is with them. You have the receipts and other evidences to prove that they have taken money from you towards this account.

On the other hand, a collection agency has sent you a mail attempting collection on the same account. So, your move should be to place this letter on dispute explaining the matter. The CA will verify it with your original creditors and the facts will come out straight. Either the collection agency will back off or the creditor receiving money from you till now will be responsible for taking care of your account. Otherwise, they can be sued for misrepresenting your debt.

It might be possible that an internal collection agency of HSBC has been hired for this purpose. There might be some type of communication gap between them due to which you might have received this mail. Things will get straightened out after you explain the matter in writing.

United Legal Corp is also among the bad collection agencies in the business. Be careful as they might be using incorrect ways to recover money from you. If they have the accounts, you know they will have to validate it. If they have sent the paperwork of Rio, it is not enough for the debt being validated. Put it on dispute and send all your letters certified with return receipt requested. You will pay only to the company that is actually holding your account. Talk to Rio Resources and get more information on this account. Check your credit report also for this purpose.

Christmas comes once in a year. Do not let it go spoiled because of these collection calls. They are now like separating clouds which will come and go. They will never stay for long. Don't let your Christmas celebrations spoiled because of these thoughts. Enjoy with your mom and kids. They are waiting for you. They need more of your attention, rather than the collectors. I will keep you as well as many of us here in my prayers this Christmas.

Can someone tell me who they really are? I have previously had withdrawals from my checking account from them but I have not used them that I know of. Do they go by any other pay day loan company name?

They most definitely are a real firm. I know because they did me the same way they did Tammy only it was a samsclub account. I was making payments to samsclub, thought everything was fine--then these guys sent me a letter. Next thing, they took me to court and I have a judgement on my credit report now for the next ten years, and here I was making payments to samsclub the whole time. so yeah, they're real all right.

Aw Tammy! I hope this crapfest boils over soon! Remember that even lawyers have to obey laws, even if their demeanor suggests to you that they think they're God.
Guess what else! Lawyers are terrible about repaying their student loans! Keep that in mind when they heckle you, that they are such hypocrites. I had a trifle of lawyers in my student loan inventory, both male and female, and they were so f'in cocky, they thought they were too cool to pay their bills. I had read their credit reports, and their credit was always crap! All their accounts in collection! Including their cell phones, credit cards, satellite dishes, mortgages, and dink-lengthening cars! Who do these people think they are anyway? How they get away with it is beyond me. There is some recent legislature concerning Codes of Ethics is certain states. Professionals who don't pay their bills like good citizens can lose their licenses!

By the way, who's the hot guy in your avatar? Your husband perhaps?

I wish it was hubby. It's Randy Orton WWE wrestler. He's a hottie! Finkelstein has had more cases thrown out of court for unethical grounds. Refusing payments, receving payments, etc. There was an article on a website I was reading that a judge actually yelled at the attorney for wasting his time, the courts time and the debtors time and threw the case out.

I hear you. Some lawyers are so ludicrous with their egos, believing that they are the law. The one nasty, ferocious, condescending battle-ax of a female lawyer in Fort Lauderdale I had contacted had five state tax leins on her credit report! All under public records! I was incredulous! I was wondering why she was not camping at Club Fed for tax evasion!
Professionals really should practice what they preach.

Jessi, you were asking me about the lawyers and samsclub. Yes samsclub was accepting my payments, I had been making payments for about 8 months and then poof, received a summons at the front door from these lawyer jerks. I was making $40 a month payments straight to samsclub, they were smiling to my face, cashing my checks and then lawyers came and sued me because they wanted $70 a month. all they had to do was say so. I got the summons on a saturday morning, called them monday morning, they said, can you make $70 a month payments, I said yes, that was that. seems crazy doesn't it??? I have this on my credit report for 10 years now.

I never really liked Sam's Club with their customer-is-always-wrong mentality. They lost me as a member almost immediately! The incident was so rediculous and could have easily been avoided! Now this with them being snaeky and underhanded, taking your money and then stabbing you in the back is just disgusting. That is such bad form for a retail outfit. You should file a complaint.

My 75 year old father just was served with papers from these folks about a credit card bill from 2000 with Capital One. My dad made two purchases on this card and paid off both. He never purchased anything else and never heard from them again until this. They said my dad owed fees and interest in the amount of 90.00 but now the cost is over 1600.00 and they are suing for 1600.00 plus attorney cost. Does anyone know what a person can do? This is one of those loans that get bundled and bought by a company LLC, etc. then these attorneys get involved because they get paid from the person. They cannot produce any documents showing that my dad ever owed the 90.00 to start with. They have a credit card statement showing a 90.00 balance and that's it. I need some help. Thanks
