Here is the response from Plain Green to my revoke ACH email.

Please be advised that this communication is for the purpose of collecting a debt. Any information obtained may be used to collect the debt. We may report information about your account to credit bureaus. Late payments, missed payments, or other defaults on your account may be reflected in your credit report.

Dear Christina:

Your correspondence has been directed to me for review, thank you for the opportunity to assist you at this time.

We understand that all situations are different and would like to offer you the opportunity to pay the remaining principal on your current loan in the amount of $550.52. We are willing to settle your account for this amount, payable in four (4) monthly installments in the amount of $137.63 each, payable beginning August 2, 2013 and monthly thereafter.

To further clarify your questions regarding the legality of this loan, Plain Green is organized under the laws of the Chippewa-Cree Tribe of the Rocky Boy’s Indian Reservation of Montana (“Chippewa-Cree”). Plain Green is owned by the Chippewa-Cree, and operates exclusively on land owned by the Chippewa-Cree. As such, Plain Green stands as an “Arm of the Tribe,” in the view of the United States state and federal courts. Therefore, loans made by an arm of a sovereign Indian nation are not subject to state law. This is NOT a payday loan.

This letter is written to help you understand that Plain Green and its loan contracts are governed exclusively by the laws of the Chippewa-Cree.

Pursuant to your request, we have removed your contact numbers from our system and we will make no further ACH debits from your account.

Please reply if you would like to accept this settlement and set up payment arrangements.

The email states PLAIN GREEN IS NOT A PAYDAY LOAN. What???????

Does anyone have any thoughts about this response email? I need advice on how to reply.

Send email that they are illegal, they know it ...as they are tribal. Keep sending and resending ....eventually they will get the message. Just trying to confuse you!

They make the disclaimer that it is not a payday loan since many states have banned or heavily regulate payday loans......it's just another way to get around the system. Do you agree that you only owe the $550 in principal? If so, then it's a win whether they deem it a payday loan or a short term installment loan.

What I finally sent them in Dec and have not heard from them since is this - you can cater to your needs - I know they owe you... and it might be easier if you keep all in one thread - so that we can better help you..

Do yourself a favor and mark my account paid in full. I am not paying you another cent - you owe me a refund of $1002.89, that I have paid on my loans with you. If you charge me off to collections I will not hesitate to not only cease and desist them, but make them aware that I informed you I am aware of the illegality of the debt and the fact that I will not be paying any remaining balance and that you in fact owe me a refund again for $1002.89. Cut the crap and save yourself the time.
You lost this one, I know that you are illegal to loan in the state I live in.

I love it! Thank you HelpinAZ!! No momofthree27 I do not owe them squat on the principal. They actually owe me, due to another loan where I paid over $2000.00 on a $1000.00 loan. I'm posting my reply email for y'all to critique before I send it to Plain Green.

Dear Plain Green,
As you can see from the law described below: Online lenders must be licensed in TEXAS. It is irrelevant that you are governed by the laws of the Chippewa-Cree Tribe of Montana. You are located in Montana and are a tribal lender, therefore it is illegal for you to lend to residents in Texas. The loan agreement may be valid under the laws of the Chippewa-Cree Tribe of Montana, but it is not valid under the laws of Texas, where I reside. My address was listed on the loan application when I applied, so Plain Green is well aware of where I live and knew it was illegal to lend to me in the first place. I am not settling for the amount of $550.52. I am in fact OWED a refund in the amount of $877.88, which I clearly stated in my first communication with you dated July 16,2013. I only owe the principal, which was well overpaid due to the illegal interest that you charged me from the loan #64620230 and this current loan #67521531. It is not legal for you to charge interest to those residents in the state of Texas.
In response to the statement that this is not a payday loan... you are an online lender. The laws still apply to you.

Just from my personal experience with Plain Green - I sent them the ACH revocation -- they hassled me for a couple of weeks and then went away. It was marked as a paid closed account on my credit report and I accepted that and didn't worry about the refund. It eventually stopped reporting on my credit report all together and I haven't heard another word from them - that was in 2011.

Just to be clear...I borrowed $250.00 from Ameriloan, and thus far have paid $75.00. I am still responsible for JUST the principal, correct??

Plain Green only reported to credit when it was owned by a real bank. That was in 2011. Now that they're tribal and therefore illegal, they can't do anything to you and won't. Trust me.

I'm still receiving emails from Plain Green. I've been receiving a few emails about my account being seriously overdue, but luckily no phone calls at work. Will they attempt to contact me at my place of employment?

Ace Cash Express gave me a bit of the run around when I attempted to pay down in four equal payments. I spoke with four different operators, two told me that they didn't offer that option, two stated that was an option. I finally called corporate, and the gentleman said he would honor what I was told, even though it was an error. Praise God!

I still owe Ameriloan the principal of $175, but can't pay that back until after school starts. Can anyone tell me the time limit once my illegal payday lender loan goes into default that I have to pay back the principal? My loan was due on 8/1/13. The principal amount is $175.00. I agree I owe the principal to them.

I have sent Plain Green numerous emails but they will not get back in touch with me. I overpaid them by $500 for the three loans I have had with them. I asked for my account to be PIF and asked for a refund. They sent me the same letter with the Native American laws but I sent them a letter back citing the laws where any off reservation business is subject to state laws. I have filed a complaint with the BBB but they stated my problem was beyond their ability to do anything. I sent Plain Green one last email stating if I did not get a response I was going to file a complaint with SC AG and FTC. So far still nothing. Not sure what next step is because they will not respond to me.
