Gosh, I have paid them $412.29 and now I owe them $595.00??
Now, here is the thing, on Oct. 9th, I went to the site: PayDay OK to choose an option for my payment which would have been due on the 12th. I got a pop up window that said either I pay off the loan in full, or transfer it to Payday One, well obviously I could not pay it in full, I didn't have the money, so I opted to transfer my loan to PayDay one, with the impression that I would continue to make payments as usual. I chose the option for bi-weekly payments. What PayDay one did, was deposit $500.00 into my account, then PayDay OK took out $575.00, because they charged me $25.00 interest, and $50.00 origination fee. There's an extra $75.00 taken from me bringing my total up to $487.29 that I have paid them. Now, after browsing this site, and reading numerous posts, I learned that PayDayOK doesn't even have a license for the state of Ohio! BUT, I am stuck with their sister company PayDay One. And the story continues..
On October 25, I sent them an email (PayDay One):
"I would like to know when my next payment is due, can't seem to find that information on this site???????"
Then I received a call from my bank that day saying that PayDay One TRIED to withdrawal $575.00 from my account but there was insufficient funds, so they (the bank) charged me a $31.00 fee which put me in the red. But I talked them (the bank) into waiving the fee because I explained to them that I did NOT authorize the full amount of the loan to come out of my account. Plus I had to go to the bank and sign a paper to stop them (PayDay One) from withdrawing any more funds.
This seems to be getting longer and longer, I'm sorry about that, but there's one heck of a history here.
Here are the email exchanges that followed this incident:

NO KIDDING!!! I only transferred the account because I had to, due to the changes. I did NOT
authorize the total amount of $575.00 to be deducted from my account! I signed up to continue
payments! Or am I missing something here???? I am not sure I understand this.

Do you mean that I can't make payments? I thought I was basically transferring my account
from PaydayOK, to Payday One, and I would be making payments, with options available
like before. I do not have that amount of money to pay this off at once. Can we make some
kind of arrangements? As I have totally misunderstood this entire situation. If you check
my past records, you will find that I have always made my payments in a timely manner.

At the "My Account" page:
- Click on the second tab on the right of the page titled: Loan History.
- On the Loan History page, all account history and loan agreements are displayed by loan number.
- When the loan number is clicked, the loan agreement will display with the terms of the loan.

Well, last Friday (Nov. 9), they took $500.00 from my checking account. I got it back after a few days thankfully, but I am still trying to reason with these people, but they are NOT listening. Now, I do not know what to do about it. Sorry this was so long! Because I don't have $595.00, I am in one heck of a rut here! Any thoughts or suggestions?

Oh and, I have already sent a cease and desist letter to them, and closed my bank account, and opened another one. I am just really baffled at the way they treated me, and I am really questioning the amount I have paid them back already, verses what I actually borrowed. I am wondering how I should handle this from here.

I sent them another email, I did some research on the Internet, and if I read the law correctly, they illegally withdrew the whole amount without my permission, especially since I had emailed them prior to this transaction stating to them that I could not afford to pay the entire amount in full, and wanted to make some type of payment arrangements, this is the email I sent:

The reason they made you change from Payday OK to Payday One is
The reason they made you change from Payday OK to Payday One is because Payday One is licensed. They wouldn't let you rollover and make payments because Ohio law doesn't allow rollovers and Payday One follows the law.
So technically speaking, they did have permission to withdraw the full amount. Because that is what they should have done, per the law. They are not allowed to do anything else.
Another thing is the the Electronic Funds Transfer Act allows for revocation of reoccuring debits, but not one time debits. That may be something you want to look into too.

I wish there was something that I could do to help you but the thing is, Payday OK was illegally rolling over loans in Ohio. That is why you were given the option to pay them in full, or transfer to Payday One, and Payday One is legal, and following the rule that there are no rollovers allowed in Ohio. Since you transferred to Payday One, I don't think you are going to be able to negotiate a settlement with them based on what you have paid to Payday OK thus far. Your best bet would be to try to make payment arrangements with Payday One. I'm sorry that I couldn't give you better advice. I think that Payday OK knew they were in trouble for loaning here illegally.

You can get out of the whole thing by changing your checking account to another bank and closing the one they have on file.....you will get alot of phone calls, but they can be ignored......they may also put it on your credit report, but that can be disputed and removed as well. I know, I've done it.

Thank you, Thank you, Thank you!!! I am so happy for finding and learning this... I thought because of their stupid clause about the transaction governed by laws of Delaware, they didn't have to be registered in Texas or they were a CSO. NOW I see they were NOT a CSO, that this was under the regulated lending laws, and they were not licensed in Texas as a lender either!!!! I have worked through paying off several payday loans over the last year or so, having had them over 2 years at an average of $200-300 INTEREST/month; that is what it is, USURY, regardless of how you dice it, as fees or a "CSO, and not a lender", when the lender often times is right next door to the CSO main office!!! And so now will only have one left, that wouldn't accept payments and had referred to a collection agency, who wouldn't accept payments either!! So these two were last on the list. I had been agonizing over trying to pay both, and so now if the other will not settle, at least it may be workable, not having to worry about this one ANYMORE!!!!!
