USFast Cash Called..and guess what>

Well, guys...USFast Cash had the audacity to call me and ask if I wanted to set up payment arrangements on my loan. I had a previous loan which I paid in full (before I found this forum) and a present one which I only had a single payment left to make.

I told the rep., Tammy, that I was recording the call and that I WOULD NOT BE MAKING ANY ARRANGEMENTS WITH THEM TO MAKE MY LAST PAYMENT. Also I informed her:

1. That they were an illegal online lending organization in Florida, where I reside.
2. That they were in violation of the interest and fee caps for this state and so, I had overpaid them on the previous loan so they should take the overage from that loan and apply it to my last payment on this loan.
3. That I had reported them to my AG AND to Oklahoma's AG since I was well aware that they were a part of MTE Financial.
4. And that I had also reported them to the BBB.

Ms. Tammy told me she would mark my account as "unwilling to pay" and proceed with collection attempts so, I:

5. Requested a debt validation letter sent via U.S. Postal Service and she stated that the only documentation she'd be able to provide me with would be a copy of the online contract I had signed.

I thanked her, told her she would not be seeing another nickle from me and suggested she handle matters in whatever way she saw fit as I was going to do the same!

Question is...has anyone else gone through this thinly veiled attempt by them to collect? And if so, what I can expect next? Will their recognition that I know the jig is up cause them to cease and dessist or, am I going to have to go down a long and tedious road....after all, they ARE illegal, the online contract is therefore, not enforceable AND, they are not meeting my request as a consumer and providing me with a debt validation letter as per my rights.

Can anyone shed some light? I'm well informed but, still slightly nervous!


I think you have to request the validation letter from a 3rd party...like if they turned you over to collections. They are in my debt management program as I still owed on the principle but have instructed my counsilor that the minute the principle is paid I will be pulling them out to fight against increases so it will be intersting to see what they say to you next...

Oh, shey, join the MTE Nightmare Train. I'm so glad you said what you said to "Tammy" the MTE stepford worker. I'm sure they're trying to call me; however, I don't answer. I hate to say this to you, but they will not leave you alone. I don't know what to tell you to expect next, as all they have done with me is go around and around in circles. It makes me dizzy. I, too, have called them on being MTE, which they continue to deny. I've been through the BBB with them, which they are now going around and contacting me directly. They will not take no for an answer. I say that I do not agree, that they are not legal, all the things you've said. And I still get emails saying I agreed to such and such (no, I did not). And the fact that these loans have been paid as per my state maximum. They don't listen, don't care, whatever. I don't know what their deal is except they are trying to make people crazy. They are also illegal in my state and the stupid contract is unenforceable. However, they still state they are turning me over to collections for $400 on a $200 loan of which $206.64 was paid. Okay. Go figure them out. I've filed all the complaints. They don't care. I think they're out in la-la land somewhere. I also am not giving in. I've paid these idiots who insist they are not who they are. Whatever floats their boats. But, I swear, they drive me insane!

Thanks, sass! Lord knows we all need *hugs* but we might not be able to hug back because soon we'll be wearing straight jackets sitting in a white padded room! LOL!

Oh, morningstarr, only in your dreams did they forget you! LOL! You're going to be sitting next to me wearing a straight jacket in the white padded room! LOL! They're out to drive us insane! They'll pop their heads back up when you're not expecting it. Like they did me. Not going through the BBB any more. Just contacting me via email directly. They are so annoying.

I've been following in Cannr's footsteps...I keep sending the SAME email to them (since they don't bother reading them) over and over again. I keep requesting everything via US Postal Service, I keep telling them that I know they're operating illegally...They can't extort any more money from me so, let them email me at will. Whomever they have call pretending to be a collection agency will simply get the "hook," and my life will continue as if they didn't exist. There's not much else for me to do and at this point, its their word against mine since they won't send any of the docs (or audit/license #'s) I request. "Spinning wheel...got to go round..." Sassnlucy, how did YOU get them off your proverbial back?

shey, I'm glad you posted. Especially today when I'm going off the deep end here. Just reading your post and realizing that I'm not the only one - so I need to stop being so damn paranoid. They are not out for ME. I am just one of many. You included. You made me realize that just by posting your opinion. And, I thank you. It kind of calmed me down a bit. When you think you're in it alone, it's scary. Then comes someone who is getting the same exact treament and it makes you realize that it's not "personal". It's just the way the operate. And your layed back approach to it all kind of calms me a little too. I need to take after you!

Think of it this way...what's the worst that can happen? They're ALL operating illegally, most of us have overpaid them and we've all filed complaints with our AG's. So, they can huff and puff until they're blue in the face but the reality is that they can't take anymore money from you or garnish your wages so what's left? Harassing phone calls from their so-called collections department? So what? Hang up! Keep up the barage of emails to them, just as I have, and eventually they'll have to give it up. They MAY be able to report to our credit bureaus but, that's why we have the ability to dispute their charges! I am SURE that most credit agencies know these charlatans well enough by now - as do many lenders and a simple explanation (along with all your accumulated documentation) will be enough to persuade even the most reluctant potential lender!

Thanks, shey. I sent One Click Cash my emails like 5 times today. They finally said - We will proceed as per our contract agreement. One sentence. Okay. Proceed away. So I then emailed them again the letter bitching to them about being illegal, blah, blah. I just thought I'd throw one more email in there after theirs. I don't mind hitting "forward" and resending them. How many times do you have to tell them YOU ARE LENDING ILLEGALLY? Lord only knows.....
