payday loans garnishments


I ran into a situation where i was struggling for money after my father's funeral and had noone to help me with this financial situation and i asked for lots of payday loans. I did my best to pay them off but all of my paycheck was just going to all of these loans and i had no choice and closed my bank account. I called almost all of them and explained my situation and advised them that i wanted payment arragements, but the problem is that when i contact them they want me to make payments like right away and i can't. One of the companies sent my payroll department a Declaration of wage assignment and my job says that it is a legal document and now my wages are being garnished. Is that legal for them to do without a judgement in the state of florida?

I had the same problem. My mother past away and I need cash fast. You need to read the forum here alot of people are in the same situation like you and me. I sent a letter of revoking wage assignment to my HR and I close my checking account and signed up with a company to consolidated all my payday loans. My HR said it was not legal unless a court order. List the name of the payday loans alot of people are wonderful on this site and will help.

Florida is a NON GARNISHMENT state. Your HR department had no business honoring that. You need to revoke that wage assignment to the PDL with a certified letter and show it to your HR. It is voluntary. You HR person sounds inept and should be working for a PDL. You cannot garnish wages in Florida from a head of household unless the person agrees to it. It has to be done through the court for no more than 25% and is still voluntary. In other words you can't garnish wages in Florida.I would go to whoever is above that idiot and report this now! I live in Florida by the way and I am shocked by this person not knowing the law.

Makita ~ if you would list:

Names of all the payday loan places you have loans with.
How much you have borrowed from each
How much you have paid back to each
And if they are internet or store fronts

We will be able to help a bit more. As stated, a lot of people have been where you are at and some still are, but believe it or not there is light at the end of the tunnel. Since Flordia is a non-garnishment state, do what Frogpatch suggested and get this taken care of.

You need to write letters to all these places revoking your authorization to debit your accounts (yes, even if you have closed your account), any wage assignment, to contact your employer or place of employment and your references. You can send these via email or USPS, but if sent USPS, make sure you send it either certified or registered, return receipt. Keep copies of these letters and do take a copy to your bank and your HR department.

Please list the info that 2nband is asking. If you have overpaid them you might even be able to get a refund from a couple if you fight hard enough. Even though 2nband looks a lot like Tim McGraw she is a very knowledgeable and caring woman whose advice is always right on the money. Just kiddin' 2n!

I am in nj and trying to find someone to consolidate payday loans. I had to auto accidents back to back borrow money not realizing it would take so long to get reimburse from my insurance, some of the loans are from 8/14/07

kimmie, I am assuming these are internet loans, correct? As New Jersey prohibits payday lending. Am I correct? If so, what companies are you dealing with?
