Help with Payday loans


Hey, everyone! I live in Florida, and I currently have four outstanding payday loans. I am not sure what to do next, so I need to help and advice. My four payday loans are as follows:

CashNetUSA $875
PayDaySelect $200
OneClickCash $200
500FastCash $200

They, of course, keep debiting my checking account so that I am now in the negative. I have tried closing the account but the bank won't do it since I am in the negative. I was thinking of calling T&C for help, but some other people suggested that I post here first because they thought maybe I could work it out on my own without involving them. However, I am not sure what steps to take to do that. Any advice you could give me would help so much.

Fist off, as I said in chat - You need to talk to the bank. If you don't get some kind of block going on the account the pdl's will keep hitting it and it will go further into the red . . . .

It's about closing your bank account. Your state prohibits criminal prosecution, so don't worry about that. While you may not be able to close it right now, they should at least be able to put a hard hold or freeze on the account, or do deposit only. This will stop the pdl's from taking any more, and causing anymore fees.

Also, I'm sure someone from FL will be around soon to give you some more FL specific advice - You will need to file complaints against all the companies that are not following the laws of FL.

You also need to revoke any voluntary wage assignments you may have signed. These are kinda like garnishments, only they are 100% voluntary. Some pdl's will put clauses in their contracts saying that if you default you give them permission. All you have to do to stop it is send them a certified letter stating:

1. "I hereby revoke any and all wage assignments I may have signed with Company X."

2. "I revoke any and all authorization I may have given to debit in any way any bank account that I may have, now or in the future."

It is best to go in person - Seriously, you will get much better results. If you want, print out some of the threads on this forum talking about pdl's taking money out after authorization has been revoked. Show them to the bank and tell them that you are trying to prevent fraud on your account.

Hi kingskid or Jack, I live in Florida and am dealing with one of those companies and a couple others. Please tell me how much you have paid to each one of them so far and we can take it from there. Listen to Goudah's advice regarding your bank. It is best to go in person. If you do not get anywhere get the name of the Regional manager.

I am beginning work on the letters. Thanks for all the advice! I know that I have paid more than I originally borrowed from CashNet. The other three, however, I have not. I have paid probably about half of the Payday Select, but the other two, none. I just want to find a way to be able to make payments on these and not have to pay them all at one. Thanks!

You've probably got a better chance to work out a re-payment with these pdl's if they don't have access to your bank account. If they still have access to your bank account, they will just continue to debit it to death for their amount. Once they can't get their debits anymore, that's when the fun begins. But since they're not able to get their money, they're more likely to work out a plan (or settlement as they call it) since that's the only way they're going to get any money. I am assuming you've gotten your bank account under control as to them not being able to debit it any longer? And, also, you know your state law regarding the amount a pdl can legally charge you? That way when they make their demands, you'll know if they're asking for above the legal maximum for your state.
