Cashland, storefront, Ohio
I have emailed and left a few messages to Cashland, but I have not received a written response (like I requested).
Has anyone experienced this? Does this mean that I can't make further arrangements to make payments now? I was going to visit Cashland on Friday (my payday) to give them a pretty big payment. Now I don't know if I should go near the place???

If you don't mind me asking how much do you owe them? I owed them a balance of $345 and they sent me to a collection agency.

It was an $800 loan - so I think it was $912.50 with the finance charges. Then, of course, I got some kind of $25 fee for it no clearing... so, a little over $950. This letter was very strange. It was naming me as a defendent, but there is no date to appear in court or anything. I am waiting for my husband to come on Friday and then we are going to look at it again together and decide what to do, I guess.

Mine was 345 plus the 25 return check fee. Maybe thats why they are doing courts vs collections they sent me to. If you are not sure if the letter is correct go to fcmcclerk.org that is the website for Franklin County Courts. Do a search for your name and then click dockets, it will tell you if/when your hearing is.
Did you receive a summons along with the letter? If so, check these forms on how to answer one or they can get a default judgment.

You can also contact your Court Clerks office directly and find out if something was filed. Sometimes these are fake, sometimes not. If it has been filed, BE sure and answer the summons and show up. They are counting on you not showing up and getting a default judgement. Alot of times, they will do a mediation with you to see if you can pay it before court. Check to make sure this is real, and go from there. We are here to help support you! Feel free to ask questions..KAren

Yes, I did get a summons... but this is the wording exactly: "You are hereby summoned adn required to serve upon the plantiff's attorney (or upon the plantiff, if she has no attorney of record). A copy of an answer to the complaint within 28 days after the service of this summons on you, exclusive of the day fo service. Your answer must be filed with the clerk of court within 3 days after the service of a copy of the answer on the plantiff's attorney. If you fail to appear and defend, judgment by default will be rendered against you for the relief demanded in the complaint."
It sounds official and everything - but again NO DATE is listed - only the 28 days thing!
Ok, it is real. I went to the county website and it was there.
Ok, it is real. I went to the county website and it was there. I understand the whole show up thing and defend yourself thing - but there is NO date ANYWHERE as to where to show up!! Do you think I should just contact this lawyer listed on the paper to see what to do? Can I call Cashland and ask to settle with them? I am now starting to get a little scared!
They are not going to set a court date until the 28 days are up
They are not going to set a court date until the 28 days are up in which you can file an answer with the court. I think that you could try either contacting the attorney or Cashland, though they might say it is too late. It is worth a shot, though. I hope that you can get something worked out.
hello
:?: In the amount of time you spent blogging back and forth you could have looked up the number for the clerk of courts, called and received an answer - probably several times over. Obviously you have defualted on a loan and the lender is interested in being repaid. They wouldn't have sought a summons if you weren't severly defaulted (meaning you've dragged your feet for a long time in paying this one back). Try and use your noodle a bit more - it sounds like you might have the right tools if you just learn how to work them.
