Is Telecheck a collection agency? I accidentally bounced a check to Wal-Mart. Somebody saying they were Telecheck called and said if I didn't pay the check plus $30 by April 13 they would add all kinds of fees and such. They started calling at 8 a.m. on Friday. In Ohio the laws say they must send something in writing:

A creditor may recover from a person who issued a dishonored check compensatory damages to the extent of the value of the check plus service charges, liquidated damages, costs, and reasonable attorney fees if a written demand in a prescribed format was sent to the person, and no payment or agreement for payment was made within thirty (30) days of the written demand.

The amount of the liquidated damages may be a minimum of $200 or three (3) times the amount of the amount of the check and all bank service charges.(O.R.C. 2307.61(A)(1)(b).)

The written demand must be sent by certified mail with return receipt requested, and generally must contain a conspicuous notice to the person upon whom the demand was made, a description of the property, a notice that if payment or agreement for payment was made within thirty days that no civil action can be brought, and that if payment or agreement for payment was not made within that time period that legal action would be pursued. The creditor is also required to
specify in the notice the potential judgment which that person may be required to pay, and that person's right to damages, reasonable attorney fees and costs in defending the case if the creditor does not prevail in the action. (See O.R.C. 2307.61(C).)


From what I read on their website,they do check verification,keep records of nsf's,and also do check guarantees. If they paid off your check,then they will be the original creditor. Remind them of your statutes next time they call. Their office is listed below.

I have bounced a check at Wal Mart in Ohio as well. It took me a long time to pay it back-(way too long due to hard times) and they never charged extra fees beyond the $30 bounced check fee. Call and let telecheck know when you will be paying it. I have found them nice to deal with. I do find it strange that they called you. I have never gotten any more than letters in the mail from them.

telecheck reports to ChexSystems! I never knew this until I was trying to open a new acct a couple weeks ago. I didn't have any charged off bank accounts so I ordered my chexsystems reports and apparently Telecheck reported me for writing a bad check to Wal Mart. It did show it as paid but is on chex systems for 5 years now I guess. This was a surprise to me.

United Community Bank lost my deposit and sent back a bunch of checks when the money was there. telecheck messed me up good over it I intend to sue the bank big time. As far as Telecheck and Chexsystems go they are like a bunch of buzzards waiting for something to die so they can destory what is left. People work hard to do the right thing. Just as soon as something goes wrong they just can't wait to destory them. That is like buzzards. I sure don't want to be in their shoes when it's time to stand before god in the judgment. I am not judging but the bible is clear about these people will bust hell wide open.

The Bank messed up and bounched 18 Checks. I paid all them with a Money order for each. telecheck has only given me credit for one of them. I had to write them a letter with a copy of one of the money orders. They read what they want to out of the letter and give me credit for the one. The otherers they have just kelp my money and think I will pay it again. I am now seeking others who this has happened to. I want to get a group together and sue Telecheck

I recently paid on a check that I had written 2 yrs ago that I just within the last week was made aware of. My question now ,will I now be able to open a checking account,since this debt has been settled? Please let me know what the procedure is after this.My e-mail is"ropowell2002@yahoo.com. I had been banking with NetBank that the FDIC closed down. At that time, I had written two checks to Walmart. Worried that they had not cleared, I have called Walmart who advised me they had been sent to telecheck. I had no notification at all from Walmart or Telecheck that the checks were out there. I had to go hunt them down. I just spoke to Telecheck who when advised I can make the payment on 3-14-08 they said it could still go to the courts since they were so old. When asked why I hadn't received any written notice they said because Walmart sends the checks electronically and there was no information. Can they really send this to court without having notified me?

worried, could it be that you received no notification of the checks not clearing because your bank was closed down? In the case of the Walmart checks, yes, you can still "get into trouble" for bad checks if they so desire to take you to court, even if you didn't receive notification. I hate to give you bad news, but I'm being honest here. Your best bet is to get these babies paid off, get a receipt showing they are paid, and get your checks back from them. Then they shouldn't be able to pursue further action since you've paid them, you have your checks, and you have a receipt showing paid.

I WROTE A CHECK TO WALMART 2 DAYS PRIOR OF RECEIVING MY DIRECT DEPOSIT FROM WORK, HOPING THAT WALMART WOULDNT CASH IN UNTIL AFTER MY DEPOSIT HAD BEEN MADE. WELL UNFORTUNATELY THE CHECK BOUNCED AND IT WAS RETURNED. BECAUSE OF BAD TIMES I TOOK ADVANTAGE OF THE MONEY AND USED SOME OF IT WITH ALL INTENTIONS OF REPLACING IT AND PAYING WALMART BACK IN A FEW WEEKS. WILL I GET INTO TROUBLE NOW? I HAVENT BEEN ABLE TO SLEEP WORRYING ABOUT THIS MATTER.
