Payday loan nightmare in NC
Since joining this community, I've learned that there is something I can do and actually see a light at the end of the tunnel for the first time in a long time.
I've taken the following steps to prevent the problem from continuing any further…
1. I learned the NC state laws regarding payday loans (payday loans are prohibited in NC and I'd overpaid each of my loans).
2. I obtained paper bank account statements for each month over the past year...clearly marking and tallying all payday loan debits.
3. I calculated exact amounts debited for each loan, noting the amount by which I had overpaid based on NC state law (turns out I overpaid by $2702.00).
4. I filed official complaints with the Attorney General's office for each of the payday loan companies continuing to debit me.
5. I filed official complaints with the BBB for each of the payday loan companies continuing to debit me.
6. I mailed AND emailed typed letters to each of the six payday loan companies revoking authorization to continue debiting my account, as well as revoking authorization to contact my employer/place of employment, or pursue wage garnishment. Each letter included copies of the complaints filed with BBB and Attorney General's offices.
7. I CLOSED my existing bank account and opened a new account with an entirely different bank.
8. I requested paper checks from my job instead of direct deposit in order to gain better control over my own money.
9. I made double copies of EVERYTHING.
10. I will continue to forward ALL correspondence to the Attorney General and BBB so that they have complete information on these companies.
I feel so empowered since taking these steps. It's as though a 3-ton weight has been lifted off of my chest. In the last year, I've had more sleepless nights than I care to count. Now I can finally breathe easy again. I know that I haven't heard the end of it from these companies as I've already received a settlement letter from MTE Financial. However, I'm in the right on this one and, with the Attorney General's help, will stand my ground knowing that these payday loan companies are spouting idle, empty threats and there is absolutely NOTHING they can do to me. These companies are finally powerless over me. If you’re in a similar situation, I urge you to learn the laws in your state…you may be surprised.

I wouldn't have known where to start if I hadn't stumbled upon this community (by accident no doubt). I'm dying to share the information I've learned with the world. These companies can't continue to get away with this!

I know how that feels, I was paying 1/2 of my cable to keep it on, my cars (both) were delinquent, insurance was cancelled, yada yada... it was horrible, we are NOW getting caught up and it feels so wonderful. I have even gone one step further (or two) by picking up TWO part time jobs to work so we can pay off credit cards and CUT THOSE SUCKERS UP!! Look out house, here we come (our goal next year!!!)~~

Congrats bflow30! Catching up financially is such a BIG accomplishment...especially after something this devastating. I too have picked up a part-time job with the goal of catching up sooner in order to buy my first house. Good luck to you and your wife on reaching all of your goals for financial freedom...I'm proud of you! :D
