I borrowed 425.00 from these people and to date they have taken 997.50 from my account. My bank tells me they can not stop them from taking the money because they could change their name and take it again. I have called them and told them they are not to debit any more money from my account but they keep on doing it. How can I stop it and get my money back?


lmleach - one of our members, Kyside, is a resident of WVA and has posted quite a bit of information here about payday loans there. From what I remember, payday loans are now illegal there - regardless of whether they are internet or storefront.

I hope you don't mind, I'm going to pm Kyside and refer her to this thread. I'm sure she'll be happy to post some useful information to help you out. Keep an eye on this thread for more info.

WV does not elaborate much, however they do prohibit payday lending.

You can request a refund and the account be marked paid in full. Make sure you get a PIF letter, that is the most important.

Send them a certified letter stating your state law and demand that they quit debiting your account. You should also report them to the West Virginia attorney generals office, make them aware that you are reporting them. You can find a sample letter on my blog at http://thehub.yesdebtfree.org

Just wanted to let you know I called them yesterday requesting my loan number ( I have never received any paper work from them at all) and fax number. The guy I was talking to wanted to know why I wanted this info, after he gave it to me I told him about my previous request to revoke their taking money from my checking account and that they drafted three times after that. Also, told him I was going to file a complaint with the WV Attorney Generals office. He immediately told me my loan was now paid in full and they would take no more money from my account. I also sent them a letter telling them I wanted a refund and one revoking their right to draft any money from my account. Also, sent complaint to Attorney Generals office.

I am a California resident. Since they could not reach me they decided to run a hard copy of my credit report and turned down the loan. I have an active checking account. I just found out today and applied for the loan last month. I have checked every page on their web site and printed it and no where is it stated I gave them permission to run my credit report. I used this service (Payday Loans) because they normally do not run credit reports and I got a letter today from my Credit Card that my FICO was lowered. What law do I use Federal under FCRA or CA State Law to apply fine. Who do I send demand letter to and what company do I use to process serve? Please help!

Payday yes has also been debting my acct for over 1100.00 dollars now on a 500.00 loan. They say that they will continue until the loan is paid in full and that will total over 1500.00. What can I do?
