I just received a call at work from a woman I could hardly understand who told me I was the "primary suspect" in something but did not say what and wanted my attorney's fax number so she could fax him an affidavit. I coud hardly understand her. I sit in a very open place at work so wanted to call her back. However, when I asked for her number she said I could not call her back and that she would transfer me to her Director to explain what was going on. However, I was on hold for so long I had to hang up since I was at work. I am very afraid now and wonder if they will call my employer or what they will do. I have had a couple of payday loans in the past that I did not fully pay off. As I am reading this website, I am thinking this is what they are calling about. I am scared to death they are going to call my employer or will file some kind of affidavit against me. The wierd thing is she said this was so important but when I had to hang up, she has not called back. I do not know the number because it comes up as "blocked" on my caller id at work. Any suggestions on what to do??

:D :D I am sorry to laugh, but that is a new one - "Primary Suspect"! In what - Murder, Mayhem, dealing with illegal pdls? What? Now let me get serious - What state do live in? And did I read correctly that you still owe on some pdls? Now take a deep breath and relax - you cannot be arrested for defaulting on a pdl, and they will not "download you" and 25 people will not show up at your house. What you can do is give us more info so that we can help steer you in the right direction.

It's a threat these scum use to scare people into giving them the money right away. And they ALWAYS ask for a lot more money than what is really owed, if the person even owes anything at all. THey threaten to download your information to the police in your area and that the police will be showing up at your work (or home) to get you by the end of the day, so you better pay us today by 4pm! It worked on me, before I found this forum. That's why I HATE these scum.

jt - "downloading" is a common threat used by payday lenders - especially those that offer loans on the internet. If you default or block their access to your bank account, or close your account, they start calling and threatening the following:

-you will be arrested
-you will be "processed"
-you will be "downloaded" or "affadavits for your arrest will be downloaded to your county"
-anything from one to 25 people will be at your door in 5 minutes to arrest you
-you will lose your home
-you will lose your job
-they will call your boss and tell them you owe money

None of the above is true, with the exception that, yes, they may try to call your boss or your employment. However, this is a blatant violation of the fdcpa - your debt cannot legally be revealed to anyone else - like your employer. The only thing they can do is call and harrass you - and you can send them a Cease and Desist letter to stop that (usually works - some lenders ignore it because they are not located in the states and think they are above our laws).

Okay, everyone, I just got another call at work from Bass and Associates. I know I posted last week when they called and left a message that I was a "primary suspect." I was away from my desk when they called but I recognize the phone number. I know you have said they cannot arrest me, etc., but what do I say to them when I call them back?? I just need some quick advice before I return the call!

First off, I would definately save this message on your voice mail. It will help convince a judge of the illegal tactics these assclowns use to extort money from people.
I also wouldn't feel any pressure to call them back. If they do, tell them they are not to call you at work anymore and can only contact you via mail--and send them something in writing to this effect.
All you owe is a debt--you are not public enemy number one, for god's sake.

kscornell is right. Companies such as this are actually stupid enough to leave violations on answering machines and voicemail. Don't delete them. And if you do call them, record (if legal in your state). Send a partial cease and desist letter (return reciept) and tell them that you'll only be dealing with them by mail. If they disregard, take them to court along with the other taped violations.
