I just got a call from Mrs Bog and boy is she nasty. Anyrate, I did not pay back the PDL when the loan was due, my mother died, I was called out of town, I had no paycheck and no money. And there is no money in my mom's affairs either. My bank account went into arrears (I am on a payment plan to pay the bank back) but I shut the account down. I am still playing catch up and planned on doing something for Nat'l $ Store, but after this call, I am about ready to say screw them, you're not getting a dime. But she has threatened to file fraud charges against me, jail time etc, what is the worst they can do beside report to my credit bureau?

Is this a storefront lender, or did you get the loan from an internet lender? If it's storefront, most of them follow the state law's and can take whatever measures your state allows to recover what you owe.

If it is an internet lender, most of them are unlicensed in the majority of states, and their interest rates are more than a lot of states allow. Also, threatening with fraud charges in the case of internet lenders is just that, a threat. They use this tactic to try and scare people into paying them.

If you can give us more info, such as storefront/internet loan, how much you borrowed, how much you paid in fees before defaulting, what state you are in, etc., this will enable us to help you out as far as what to do.

If you need help with payday loans, got to Removed, solicitations are against the TOS, Shazzers This is a great company and they will help you.
You cannot get jail time for not paying a bill. Just call the police dept. and they will tell you that its only a scare tactic that collectors use.
All they can do is sue you or report you to chex systems.
I would suggest that you pay them with the help of an agency like Progressive.
I used progressive to repay 4 payday loans that I got in trouble with and They handled everything for me, the phone calls and negoitiations and everything.
Its better to pay them I think than to just say screw them. Although they are nasty, you have to fight fire with fire and get them out of your life, you'll feel better.
