I'd probably send a few letters.
The first would be a letter requesting validation
The second would limit communications from them to be in letter format only. Make sure you send your mail via return receipt.
I'd keep an eye on your bank account, a lot of shady collectors will withdraw more than you agreed to. You may be able to revoke your current payment agreement, and change it to snail mail. You'd also want to do this with a CMRR letter.
regarding law office of mitchell n. kay
what is a CMRR letter? I have take the first two steps. I concerned that once I make the payment, that I will not get my letter in a timely fashion. How long do they have until I get my letter saying that it is paid in full?
Certified Mail Return Receipt Do you have anything from them
Certified Mail Return Receipt
Do you have anything from them in writing? If they have offered to settle with you, get that agreement in writing before you make your payment. I'm not certain that they are required to send you a PIF letter, but as long as you have their terms in writing, proof of delivery to their office, and proof that check/MO was cashed, you should be OK.
about fraud
I found out yesterday when I called the original creditor of Brylane Homes that Law Office of Mitchell N. Kay is not the collection agency that represent them. It is another company. They lied and now I have a schedule payment check that is suppose to draft out of my account on the way. I dont know what to do. I hoping that when i call my back today that they will be able to stop the check.
Sounds like you might need to file a complaint with your attorne
Sounds like you might need to file a complaint with your attorney general, maybe the FTC for Kay attempting to collect a debt that is not yours.
Maybe you'll be able to put a stop payment on the check. I assume you did one over the phone, did they give you a check number?
