downloading affidavits


Does anyone know if it is possible to have an affidavit downloaded to court from a collection company. Bass and associates had just called me and asked why I havent sent them anymore money. The last time i sent this guy Sonny money I stated that i wanted something in writing and he said fine. Today when he called he was very rude so no he didnt say that, that he has tried to help me and wanted more money. I am willing to pay for these loans I had but not the amount he wants. So in short he said he was downloading these affidavits after he hung up. After reading all of the posts on here, is it possible for then to have me arrested?


No affidavits will be downloaded, this is just a bunch of crap they throw out to scare people to try to get them to pay those crazy amounts. Several people on this site have been threaten with those affidavits. Don't worry nobody is going to come arrest you.

As you have probably read, several people are having problems with this collection agency. We are encouraging everybody to file a complaint with the Florida Attorney general and also the FTC. They are required by law as an collection agency to provide debt validation and nobody on this site has been successful in receiving one of those. Are they giving you the name of the payday loan company? If they call back, let them know you will be willing to set up payment arrangements but you are not sending any money until they send you debt validation.

The last time I made a payment to him he said he would mail somethin in writing. I originally stated to him i would make payments monthly, but after the second payment i made i told him i wanted something in writing as to where the money was going and he said fine. Since i hadnt received anything in writing that is why I dint make the payment. And the amount he said I owed was much greater than what it should have been.

Yes I had to make the payment using moneygram. He says there is nothing to send me in writing? Paid a total of 612.00 dollars. he says i owe somehting like 1850.00.........the original loans were for 200, 300 & 300. So even if I add the interest of that 30 dollars per 100.00 it doesnt equal his amount. I had the loans with fsm, sjm and bjt I believe. I had ori

I had origianlly signed up with a firm that was suppose to handle these pay day loans that ic ouldnt pay, after i enrolled and started getting the calls form this guy they told me sometimes that the pdl dont work with them. So i got screwed out of that money also. Is there anyway to find out if an affidavit was actually downloaded?

I clicked on your states laws and it appears that Payday loans are phrohibited in your state. I would definatly request a paid in full letter and immediatly contact your Attorney general and file the complaint. They may also be able to give you advice or assist you further in getting these clowns off your back.

Thanks. I will do that. I wasnt sure what that probited actually meant, whether we didnt have a law or they couldnt do business in the state. Should I be worried about this guy, he said they were filing felony charges for fraud, and i used the internet to commit fraud etc.........by reading what u wrote u have been dealing with this for awhile. so i guess if nothing happens with these so called affidavits, i will still be called.

He is blowing hot air. You did not commit any felony let alone any other crime here. That is just a famous threat these people love to spew out of their mouths. You are going to be fine. Call him on his bluff, and if you want to get technical about it, that person is the one who committed a felony, he committed EXTORTION by making that illegal threat to you in order to get money from you.

I have received a phone call this evening from Bass & Associates. Gloria Robertson & Kelly Young.

Point blank told me I had to pay $562.50 or I they would be downloading 3 affidavits to my state. I'd better get a nice suit because I will be going to see the big man.

I asked to have this mailed to me but was told they could not because they are not a collection agency.

I called and filed a complaint with the FTC. Bass & Associates is in violation. 1 They did mail anything, 2 failed to identify themselves as a debt collector

It appears that payday loans are prohibited in your state and they only allow $17 per $100 borrowed up to $600. So, I don't see where Bass & Associates think you actually owe that ridiculous amount.

Don't worry about the threats this company is making. If you want, take ONE more of their phone calls, and advise them you are reporting them to your state Attorney General because they are lending illegally in your state. They will threaten to have you arrested, say they're going to have someone at your door in 5 minutes to arrest you, say they're processing affadavits, etc. None of this bears any weight at all - stop and think about something:

if this company tried to have you arrested, that means they would have to show up for a court date IN YOUR STATE. They are operating illegally in your state. If they step foot in a courtroom, who do you think is going to be in MORE trouble - you, for taking out a loan with a company you had no idea was lending illegally, or them - for operating a business illegally in a state where they have no license to do business, and on top of it, are offering a loan product that is illegal in your state?

They don't have a leg to stand on, and they know it. That's why they threaten people - they are COUNTING on your fear and intimidation - they think if they push you hard enough, you'll pay. Stand strong and fight back! You are in the right here - you've paid what you owed them, and they are way over the line in asking you to pay more.
