How can I avoid my wages from being garnished?


I co-signed an auto loan for a friend. One year later, he got sent to a conservation camp and the vehicle got reposessed, I could not pay for my car and this one. Now another year has passed, Daniels and Norelli have been calling repetitively, faxing my employer for verification of employment, and will not work out a payment plan with me. They wont a certain amount down right now, then a certain monthly amount afterward. I let them know what I could pay and they say they CAN NOT take anything less than what they proposed. They are not even trying to locate the friend that took out the loan, only the cosigner - me. Now they say they will need to process paperwork and threatend to start garnishing my wages. Is there anything I can do to prevent this??


The creditor will be pushy because you are put as a co-signor for the loan. Remember, wage garnishment cannot happen without court orders. Only the judge will decide if your wages are to be garnished after hearing your case.

The creditor needs to file the legal papers in the court and summons will be served to you 20 days before the court hearing. Keep negotiating with the company if you are able to work out something outside the court.

If you want to stop going to the court, pay what the creditor is asking from you. I can understand this is tough in your situation. Don't be worried going to the court. The judge will not fix anything that you can't afford.
