You've done a tremendous thing in West Virginia. I applaud you on your efforts. I'm glad to hear they are going after so many at once. Tammy, yes the complaints do count. I sent a second/third round into the consumer protection office in my state after I read an article on this forum. It was in reference to payday lenders here, mainly internet ones who do not follow the state laws. I'm glad to see this. I agree that we can make a difference :-) I think a lot of things have changed since last winter. I hope these internet lenders realize that they are no longer invincible. :-)

Maybe the loan companies being sued by West Virgina's Attorney General, are going to counter sue that state, based on internet law, jurisdictional issues. If a lender has a license in NM, or DE, that is where the transaction occured, and in those states, the loan is perfectly legal. IF you buy something on EBay, and you live in Georgia, but the Ebay server is in Florida, and the person you bought the item from lives in california, where did the transaction occur? West Virginia's Attorney General has no shot. Maybe he is up for re election, and given the timing of the news, one can see his cynically transparent motives. His expectation is that given the IQ of his electorate, which is similar to the IQ of those on this forum, he can appeal to those dumb enough to vote for him. Maybe the AG of WV should worry about all the miners that die in his state, from dangerous and abusive workplace safety violations.

Hey Shadow, It is definately possible that the payday loan companies will try to counter sue. They have tried it before and failed. Which one of the payday companies do you represent and I will be sure to tell AG to shut you down as soon as he can. Shows you how much you know he has already shut down 18. If they are so right that they have jurisdiction then why are they caving? Also Attorney General is not up for re-election here. The elected officials here are very caring about the miners. The remarks you made were idiotic and when you get the behind to be a coal miner then maybe you can talk. Until then WV is proud of its leadership. Also if you are so smart check the federal law on jurisdiction for payday loans. KYSIDE38

What the F@*$! You sick twisted B@$t@d!!! Good job Kyside, screw this moron who hides behind "shadows" whatever.Don't get me started. And many states are coming down on those who purchase goods via the internet. OH has actually tracked OH consumers who purchase cigarettes via the internet and bypassing paying the taxes on them, guess what, those consumers are getting their tax bills in the mail and will have to pay up. I suggest you polish up that resume or be prepared to stand in the welfare and unemployment line because that day is coming sooner than you think. I can not even believe some idiot had the nerve to compare a tragedy such as mining deaths with this, that is sick. And as sad as that is, there are still issues that need to be resolved in govt. and govt. must continue and make decisions that effect their citizens. I am probably not even making sense and rambling, I am just sick about that comment.

Shadow. Another lurker that attempts to twist the law to make it look like they are no committing any offense.

The fact and business of eBay has nothing to do with internet PDLS. you are comparing apples to oranges. The law of each state are fairly clear. Becuase they are a business providing a financial loan, they are governed by the state the transaction occurs, not where they are located. It is the same reason a lawyer must pass the bar in the state that he is practicing. Just because he passed the bar in OH doesn't mean he can provide his service over the phone to someone in CA.

Now go back and read the law carefully. And then don't come back.

I am wondering if the shadow works in the pdl industry. I don't think using an E-bay analogy with payday lending is really the best way to look at it. The laws are simple in each state. No, the transaction does not take place in the state of the lender, it takes place in the state of the consumer. I have had this confirmed on numerous occassions by different AG's offices. I know they all can't be full of crap. In my state it is illegal to lend money to a consumer here without being licensed. It's the law, read up on if you want. Also, my state is also cracking down on internet lenders. I'm glad to see this type of change :-)

First, your wrong, the transactions are deemed to have been executed in the state where the consumer resides unless otherwise specified, AND allowed by law. If this were true, they why do states feel they have the authority to go after these lenders, and why are more and more of these lenders choosing to settle accounts when they are confronted with these states laws rather than stand their ground if they feel they are operating perfectly legally?

If all goes as planned, I will soon be moving to NM (returning to NM actually). Once I return, I plan t to make it my goal to have the laws of the state of NM changed to make NM less friendly to predatory Internet lenders, and payday lenders in general. Having Grown up In NM and having most o my family still there, I feel it is a blemish on a state with great potential for growth to play host to such a seedy and corrupt industry.

I read in the Asheville Citizen-Times on Nov 9, 2006
that the payday loan companies agreed to pay 60,000
to Consumer credit counseling to help individuals
settle their accounts.
