Wage Deductions Laws in Texas


Just thought I'd share this with everyone...

One of the most troublesome aspects of determining what wages are due and unpaid is the question raised by deductions from wages made by the employer. The employer may not make deductions unless ordered to do so by a court of competent jurisdiction (as in court-ordered child support payments); authorized to do so by state or federal law (as in IRS withholding); or authorized in writing by the employee, and then only for a lawful purpose.

The latter category is the one that causes many problems. Authorizations that are too general or too broad may not be given effect.

Deductions for out-of-pocket loans to an employee, even though there is an oral agreement to repay, or even to repay out of a particular wage payment, will not be allowed, unless the deduction is authorized in writing.

Employers must be careful to get a proper written authorization before making a payroll deduction.





HMMMM...Wage assignments are classified as "voluntary deductions". So this means that wage assignments ARE allowed in Texas, as long as proper protocol is followed. Someone had pmd me that question, and I talked to the person who does my job in our Houston office..She had no idea what a wage assignment was..she had never handled one before.

Yeah, but actually, Sonic tried to send one to my HR person a couple of months ago...BEFORE they marked me PIF, and my HR person (who is VERY good) let me know first before contacting Sonic, and told me that they would not honor these types of wage assignments without a VALID signature, which is NOT the "digital" signature that most of us provide when getting PDLs...so...they will honor these things, but on a very strict policy basis. I have something else that I will post on here in a sec...it's a list of types of assignments and garnishments TX honors.

I know my employer wont honor them unless it is court ordered , However I am worried about the one that I have with this PDL that says they are in the UK and doesnt have to abide by the laws here and are threatning me and my family,
Couldnt they get a court order where they are located and try to serve it that way?
However I did send them a certifed letter to stating the laws here and no response just the threats when I called to make payment arrangement with them

Like Finsfan said above, any loan company doing business in US has to follow the protocol regulated in this country and the laws followed in the respective state. They cannot garnish anyone's wages without court orders. Which loan company are you dealing with based in UK? I wonder if its ICS.

I bet it's ICS too...Yes, they do too have to follow your state's laws. They won't garnish you..They're never gonna get a judgement to do so.

Wage assignments are tricky..At my job, I have to honor them, unless they're rescinded. They are very very rare, and even payday loan companies don't use them often.(except Sonic sure seems to like them!) I've only seen a couple in my 6 yrs of HR. Some companies simply don't honor them as a matter of policy...A lot of comapnies only allow IRA deductions and 401K as the only voluntary wage deductions allowed. At any rate, even if your company did honor an assignment, you can easily stop that
