FNCL - who is this corporation?


Does anyone know an address for FNCL Corp of America? They are on my credit report and I have been trying to send them a debt validation letter. I used the address on the credit report and it came back undeliverable.

A couple tips for you--first, ALWAYS send any letter to a CA by certified mail, return receipt. That way, you will know when they get it and you will have proof that they got it.

Second, and this is a big one, they most likely have illegally reported this account on your credit file. The Fair Debt Collection Practices Act requires that they have 5 days from their initial collection attempt to send you a consumer disclosure that explains your right to dispute, and so on. My guess is that you didnt know anything about this until you looked on your credit report. If thats the case, then they undertook collection activity without providing the proper disclosure. This fdcpa violation is important--it can cost them $1000, payable to you, if you sue them.

OK, moving on, when you send the validation letter, the law requires this CA to note on your credit report that the debt is in dispute. Most CA's dont bother doing this and most consumers dont watch for it to happen on their credit reports. But they must put that note on the entry. If they dont they have just violated the Fair Credit Reporting Act and you can sue for that too. Now, once they get your validation letter they must stop all collection activity until they provide you with the validation from the original creditor. If they do not provide this information but then start calling or sending letters to you asking for payment, then they are violating the FDCPA again--$1000 per violation can add up in your pocket.

Some other things to check--what state do you live in? Each state has its own laws regarding debt collection. Many states require that a CA be licensed or registered in that state or else they cannot legally do business there. This means, in your case, if they are required to be licensed in your state and they are not, then it may be illegal for them to report on your credit file at all. The federal authority that enforces the FDCPA has stated that credit reporting constitutes collection activity.

If you post what state you live in we can give you more answers. Also, does the entry on your credit report have any dates listed? It's possible that this debt isnt even within the statute of limitations for your state anymore.

Just tried to get an apt. and this company is trying to collect 93 dollars from me? WHATT!

$93? Did they say what it was for?

If you have an idea of what it is for do you know when the last time you might have made a payment? Also what state do you live in?

Most likely it is a REALLY old debt and is time barred. They will try to collect and threaten you but legally they can't sue, only call and send letters.

If you get anything in writing, send a debt validation letter to them. You have 30 days after initial contact in writing.

I just called and Got through to someone about what it was for and gave them my Social but they said nothing was coming up. the date it opened was Feb of 05 when I told them it was from 05 they put me on hold??? What the hell is that they should be able to pull it up with my Social right??
