AFNI debt collectors.... a scam?


In February of 2008 I was renting a condo and there was a fire that started in my unit when I wasn't home. My landlord called me and I rushed home to find the kitchen and roof had been destroyed and I lost my dog. I did not have renters insurance at the time. Later I talked with my landlord's insurance fire investigator and we went through the whole apartment and it turned out two other apartments were affected but not as bad as mine. I saw all of their insurance companies at their apartments. Anyway we made numerous phone calls to the fire investigator to see if they ever determined what caused it and I got no return calls. Two weeks ago I got a call from a debt collector that said I owed them $16000 dollars for one of the neighbors apartments and they said they were working on behalf of USAA who was ONE of the neigbors insurance. Now I know the HOA of the condo has insurance on the outer shell and the landlords on the inside but I never received a bill or itemized bill from USAA or any insurance company. The bill collector is AFNI and I googled them and hear its a scam but I don't want my credit ruined over this. Please Help! Ryan


If they called you then according to federal law they now have 5 days after their first initial contact with you to send a letter of collection via the mail. If you type the name of this collection agency into the search box located in the upper right hand corner of this forum you can read what other members have written about them. This has to be a scam because I've never heard of such a thing. Keep checking back for more replies.

Sounds like a scam to me too.

I think you are better off talking to a lawyer about this, I do not see how you have to pay for any of this. If the fire is ruled as accidental or if it was due to faulty equipment such as wiring you have no obligation to pay. If it was on purpose, you would be charged criminally and be in jail.

That is how I see it. So seeing as you are not in jail, it was not your fault and you do not have to pay. Furthermore I do not see this going on your credit report, if it does, dispute it. The only things that go on credit reports are for family personal and household use if I am not mistaking. Other things are public records such as judgments which this is not any of the above mentioned. You have not been sued on this.

Definitely talk to a lawyer on this though. You may be putting money in your pocket if I am right on this.
