Wage Garnishment

Filing for Chapter 7 BK on 6/30/09. Court date for judgement on 6/4/09. Attorney advised me not to go, will be judgement default. I live in VA. Is there enough time for creditor to garnish my wages between court date on 6/4/09 and my filing date on 6/30/09. Attorney unable to meet prior to that to file, just worried they can garnish my wages by then. Is 25% the max they can garnish, I know VA follows the fed g/l - but they can't take more than 25% right? And 25% of what - my net pay, my gross pay?


that is 25% of your net after all deductions.IMO,but if you have everything in place for the filing i would bring it to the court date.show the creditor and judge that you are filing BK at the end of the month.your attorney said that because once you file everything is halted.including judgements and garnishments.so if they got a judgement it would stop once you filed.i just don't know if a default is awarded if they garnish right away.you will get a judgement either way,but iwould try to talk to your attorney about the garnishment thing before deciding on if you should show up or not.
