I'm exhausted. I've been trying to get this guy to pay the judgement I have against him for 2 years, I just got news that he has filed BK (I'm in Calif./Community Property State). He has been married the entire time and she was not listed in my judgement against him, but I believe I can still go after her (somehow) to get her to pay the judgement. By the way, she was part of the scam that got the judgement to be in my favor, I just didn't know to list her as a defendant, so she wasn't listed on my judgement. Does anyone know if I can figure out how to go after her for the judgement? It just doesn't seem right.

Thanks for all your help. :)

If you have judgment against somebody, you can either garnish his bank account or his wage but not his wife's, even if she is a part of the scam. However, if he has filed bankruptcy and the bankruptcy gets discharged under Chapter 7, he may be exempted from paying the debt.

This is not the answer I expected to get. I did not know that there was such a thing as a 341 meeting. Do you have more detail about that? How would I object if he has a legal right to file bk?
I do appreciate your responses...:)
