Hello, I have filed for Chap. 13 bankruptcy without my spouse. The Trustee is really giving me a hard time due to the secured loans are all in my spouse's name...car loans & mortgate...I have provided her with the car loan statements and now she is asking for a certified copy of oru deed...my attorney's office says this is normal but I feel like the Trustee is making it hard for me to file a Chapter 13 & would rather I just file a Chapter 7...has anyone else had these kind of problems?


I am filing due to my husband's hours at work have been cut in 1/2....with this major cut once we pay the house payment, equity loan payment, & car payments there is barely enough left for groceries....the secured loans are in my husband's name because he has excellent credit & was given the better interest rates....my credit is bad & I only qualified for high interest loans and those have all gotten behind since I am making sure the secured loans are paid....the unsecured loans are all behind & 1 has gotten a judgement while the bankrutpcy was being prepared.....

I'm kinda surprised she's giving you a hard time. The creditors would rather have you file a 13. At least they will get something.

You don't have to justify your filing what you filed. You are entitled to a bankruptcy whether she likes it or not.
