Fair debt collection


Hello -

I have several questions that re not addressed specifically here regarding fair debt collection. I have a creditor calling me repeatedly regarding a check written fraudulently from my account, which I had closed and it came back unpaid to them.

I have sent them a letter disputing the debt. they never sent me a follow up letter listing the debt, but they continued to call me. I again sent them a letter asking them to stop contacting me by phone and to only contact me by mail so that I may have hard copies of everyhting in the event I need an attorney. The day after they received my letter, they called and asked for my attorney's name and case #. First of all, they called after I specifically asked them to, second, i am ot sure if they are entitled to that info?

Finally, i have repeatedly asked them in written correspondence why this debt had not been attempted to be collected by the original creditor before being sent to their agency. They have yet to answer this question. As a result, there is a $40 collection fee tackd on to the original amount. i find this strange since the original creditor made no attempts to contact me prior to sending to this collection agency.

Are all of these things legal for them to do?

Usually, the creditors pass the debt to the collection agency when they fail to directly collect the money from the consumer. In your case, since they didn’t inform you about your debt, you should talk with your creditors regarding this matter because they failed in informing you about this debt.

Also, if the debt has not been sold to the collection agency, then you can still work with your creditors. Usually, the creditors sell the debt to these agencies after a period of 180 days if they are in default.
