I took about a payday loan in April for $200 and with their roll over fees it soon be came unbearable. I recieve a call from this firm in June and the woman I spoke to demanded I pay $600.00 or I would be sued, since I was so scared I sent a $100.00 money order to their office in Canada (this is where they are based), being a full time student with rent, bill, cost of school... I was unable to pay the rest. Today, i recieved a voicemail from an associate at his office stating that since I have not paid my debt I would be served with in the next 5 business days by my local autorities and a law suit was going to be filed against me. She then stated for my lawyer to contact her firm immediately to tell them who would be recieving my notice. I dont have an attorney, nor can I afford one. I dont want to call their firm because my phone was outrageous since it was a call to canada and they do not have a 1800 number ( i thought they were required to have a 1800 number as a collection agency). I am so stressed out and depressed, it is literally making me ill. What should I do?? Can they really sue me? What about the fact they are in another country, who's law are we abiding by US or Canada?

Although, the laws in US and Canada are somewhere inter-related but they will have to provide you complete information on the said debt. It is your legal right to know the complete details of your account and if they can't validate the debt, you have the right to refuse payment.

Please do not stress yourself regarding this matter. They are using scary tactics so that you start making payments hurriedly. Please do not get intimidated at their calls and ask them to validate the said debt. They need to provide you with the following information.


  • The details of the account.

  • All the calculation should be shown of the amount that is owed.

  • Any copies of the papers to be furnished that shows the payment agreement.

  • Provide a verification or copy of any judgment if applicable

  • The original creditor needs to be identified.

  • The Statute of Limitation needs to be proven for the collection of the debt.

  • The license of the collection agency applicable in the state is to be furnished along with the license numbers and Registered Agent

  • Proof of the agreement that the debt collector has purchased the debt or has been hired by the creditor to collect the debt from the debtor as this is the basic contract law.

  • Complete payment history showing the details of the creditors, payment history, amount of the debt, break up of fees/interest should be provided in paper.

  • A copy of the original signed loan agreement between the debtor and the original creditor establishing the debt between both the parties also has to be produced.
