ERSolutions - Anyone know??
Recieved a letter today, from an ERSolutions.
Claiming that I owe an Asset Acceptance compay a bit under 2 thousand dollars.
Problem is, I've NEVER dealt with either company, so I know I do NOT owe money to either one. Interestin though, in that the individual the letter is addressed to is NOT me. If it was, then they never bothered to learn how to spell, because the last name is NOT mine.
I'm intent on sending a letter back, letting them know of several errors made, as well as requesting that they prove what is a fraudulent claim on their part. And can prove it with information I've seen, and printed out from online.
Information is appreciated.

Two possibilities are there, behind the letter.
First is that, you really have the loan and you are forgetting it and secondly some one is trying to impose it over you. Whatever be the reason, you have full right to know the source of your debt. You have the Fair Debt Collection Practices Act and debt validation rules beside you.
As you have mentioned that you never dealt with the companies and the last name letter is addressed to, is not also yours you can surely ask the reason of such a letter. And if you can prove their fault, they will remain legally bound to compensate you.
The right procedure will be sending them a letter first, as you have decided. You can also post some complaints to some sites including the letter you got.

My brother received a number of calls from this very rude person, he lives in another state in another state from where I live. I received a message and called back and talked to this extremely large A-Hole.who threated me and other such things about a debt that is seven years old and was my exe"s. That was two days ago. My brother in another state, today received 13 calls from someone that is too rude to leave a message each time he called! Gee I wonder who!!

As per The Fair Debt Collection Practices Act, the bill collectors are restricted from imposing harassments on any consumer. As it is a federal law, so it is put into effect in all the 50 states in US. Under the Section 806, the debt collector is restricted from involving in any kind of repeated personal contacts with a consumer with such frequency to harass him.
You and your brother should notify the debt collector in writing to stop all the communications and they are required to follow it after receiving your letter. This will include both the phone and mail contacts. It will be a wise move if you can send your written notice through certified mail and requesting return receipt.
There are some bill collectors who are persistent despite the law. The Federal Trade Commission will be a true help for those helpless consumer and hope for some soothing help at their toll free number FTC (1-877-FTC-HELP).

Like about a year or so! Had major problems with what I still firmly believe was an illegal garnishment.
Knew absolutely nothing about it until I got to work one day. Stole about $1500, that I'd like to attempt to recover, plus additional damages, from BOTH parties involved.
If I'd have known about this site then, I could have taken necessary actions by fighting back!! Have an idea, that I was thingiong about during work last night. Just don't know if what I'm thinking would be possible for me to do. Maybe another thread for a different time.

Said they will accept 60% of the account. Of course, they want $1,187.50 in 14 days.
It'll take me 8 MONTHS to attempt to save that much!
I'm lucky, after paying truck payment, insurance, phone and DirecTV service, if I have $200 left over, and I gotta start paying part of that bvack to my folks!!
Interesting in that absolutely NOTHING has been mentioned about the incorrect name etc......on the letter recieved. Still states the wrong last name and/or the incorrectly spelled last name.
The letter recieved shows asset acceptance llc as the creditor, and a balance owed of $1,979.16, which is NOT the case. I do not owe either company the money stated. Will send one last letter, requesting validation, etc........from the various letters suggested here.
What would I do next, if requested information is not recieved, which I'm doubting it will be??

I believe this letter from ERS is incorrect. You definitely need to ask for debt validation and see if it is shown legitimately.
If they do not reply to your validation letter and still keep calling you, you have the right to take legal action and sue them up to $1000 as per the Consumer protection afforded by the fdcpa Section 809 (b).

I received a letter today correctly addressed to me from ERS indicating I owed them $262.33 on a Cingular Wireless account. I have never had a Cingular phone, it is not even available in my area. They are willing to settle in 14 days for $209. What is this?

Welcome to the forums. You should pull your latest credit report and check if the said account is shown in your credit report. As you say that you never used a Cingular phone, this will not appear in your credit report.
You can ask your creditors to validate the said debt providing complete details of the accounts. As per the fdcpa law, they are required to prove this debt with all the necessary information.

If the said debt is not legitimate and the creditors report it inaccurately to the bureaus, it is defamation and will result in financial injury. You can fine them up to the extent of the damages incurred by the wrong party as deemed by the court.

Work and daily life kinda got in the way!! Anyway....I ended up sending out 2 validation requests to two seperate companies, stating I owed them money.
Also sent a request for information on an account that was canceled by the collection agency dealing with it.
And they sent notice within 2 weeks of recieving my validation request!
Now, the wait begins to see what becomes of the letters mailedout today, Aug 26.

When I get yet another call from the people at ERSolutions. Had sent a letter once, stating no phone calls, requesting claim validation etc......No money to cover a Return Reciept unfortunately. Planning on sending another letter shortly. Want to also inform them that since my first letter was sent, they have been in direct violation of the law, as per my written requests.
What makes this call interesting, is there was absolutely NO useful information given. The caller basically provided an 877 number and said: Call this number for an important message. Hours are 8AM to 5PM CST(I think). If you need to talk directly to a person, call this number and press 0(zero). Or at least a message something along this line!!
Caller did NOT say who he was, who he represented, who he was calling for etc....

It is necessary to send your certified letter with return receipt so that you are sure that it has been received because of the date printed in it. Otherwise, you won't be able to prove later that you have sent the mail to them.

I have received numerous phone calls asking me to "press 9" to speak to a representative. And that they weren't a solicitation.
Curiousity bit me and i pressed 9. A lady answered asking for Nicole or Keith. Well, I don't a Nicole or Keith. I asked for her manager and she asked why and I said "Because I don't want to receive any more calls from you" and she said "well have you ever answered the phone and spoke to someone before?" If any wrong information is there in the letter, dispute it. Send them a dispute letter, attach copy of their correspondence and mark the item that you want to dispute. Send the letter via certified mail with return receipt requested.

I have been getting nasty phone calls from ER Solutions looking for an ex husband of 12 years ago. The only info I could get out of them (through the rudeness) was that I came up as a "reference" for my ex's account info. That is as far from the truth as WMD in Iraq! Anyway, I have expressed to them that I have zero contact with this person and do not have any knowledge of his current situation. I also expressed that he has no legal right to use me on any financial transaction at all. They keep calling anyway...how can I get this stopped? PS. I checked my credit report and it has no problems or errors; I am on a credit checking program now to report any discrepancies that may pop up. I did a google search on the ex and found his home address and employer; should I share this w/ ER or contact the ex &/or his employer?

But, you can stop them from contacting you legally. A cease and desist letter will be the best legal move from your side. The FDCPA explains the consumers' rights when contacted by a CA. Here is a template on how to write a cease and desist letter. Send it through certified mail with return receipt requested.

I was a client of Washington Mutual a couple of years ago. I had a DISPUTE WITH A.O.L over charging my account when I had requested to cancel my A.O.L. Account. With time there was nothing else I can do but to close my Washington Mutual Account. On 3/15/06 I received a letter from ER Solution post marked on the letter 3/3/06 (yet received it by hand from mailman on 3/15/06) requesting for me to response within 14-days. I called on 3/15/06 @4:30pm and spoke with MS EKIKO at 1-800-622-8034 ext#5520. She demanded that I paid the balance of $255.59 and at that time I did given her my friend acct # and all information needed. Ms Ekiko gave me the confirmation and said it will take up to the 31 of March to clear. After the account becomes clear I will receive a letter from them saying that my account was clear and in 0 balance.
On 9/20/06 I called and spoke with a representative and told me Ms. Ekiko was not in that I had to call tomorrow meaning 9/21/06. I called 9/21/06 once again I was told to call from 7am-3pm central time that was her working hours. At That time I asked the gentleman why I have not received the letter he stated that I had to call back after the payment was cleared to request the letter. I informed him that was not what Ms. Ekiko said, but I will call back.
On 9/22/06 I started to call since 7:00am central time like I was instructed. The call rang twice then busy signal came. At about 7:20am I was able to speak with Ms, Ekiko and requested the letter to be faxed. I gave her my fax number at that time she said she did the request and the letter will be faxed by 1pm central time. At 2:30pm central time I called to spoke with Ms. Ekiko and she was not helpful, she was rude and when I asked her are you a legit collection agency, she stated yes. Then I asked her I would like to speak with her supervisor, at that time she handed up.
I called Washington Mutual Bank spoke with a representative and hopefully I get the letter within 7-10 Business days.
I understand these collection agencies must focus on collecting, but never should this kind of rudeness nor degrading should be conducted under no circumstances.

I've received a letter from ERS about a debt I owe. The first one I ignored, but this second one they've dropped the amount owed down by 30%. They say they have the ok from the company I owed it to. But I wonder as the company I owed it to would not even deal with me on it at all. Of course it was a cell phone company that would not drop the disconnect fee when I moved out of state where I had it to another state as I had to take employment in a state where the cost to keep the phone was so expensive because of the roaming fees..etc...
This is the first time in 1 1/2 years that I've heard anything on it since the cell company wouldn't work with me on it back then.
My question is, do I call this ERS or write them a letter stating what I can pay each month and how I will pay it..etc...??

I have also dealt with ER Solutions. They stated that they were collecting for Washington Mutual who I did owe money to. I made payment arrangements with ER Solutions yet I was getting collection calls from Washington Mutual. I called Washington Mutual to inform them of the arrangements with ER Solutions and they said they had never heard of ER Solutions. So I put a stop payment on the arrangements I made with ER Solutions and sent them a letter requesting proof that they are collecting for Washington Mutual. This was about a month ago and I still have not received any proof from ER Solutions.

IF You've read enough stories here, you'll see that folks are being faslely accused of owing from hundreds, to thousands of dollars on an account they NEVER had.
Only because the CA's decided that a persons name and/or SSN were "close enough" that they'll report what they want, until they get what they want. Which is usually money that is NOT owed by a particular individual.
That's one of the reasons that folks here say to get VALIDATION from any CA. Make them prove to you, that they do in fact have a legit account of yours. If the information doesn't match, the there shouldn't be a reason to pay for something that isn't mine etc......
I've been sending out Validation letters for some time now myself. I get the Return Reiept back, but for some "odd" reason, I never recieve anything else regarding the account in dispute.
What it comes down to, is really quite simple, I think. No valid proof, no money.
Just my opinion(s) on things. Based on what I've learned and read here. Could be wrong. Would not be the first time, if I am wrong. Certainly not the last time either. Corrections always welcome!

These scumbags called me up twice so far, and are trying to collect a debt from someone who spells their name differently from me, for an account I never had.
The guy claimed his name was Rich Garza (sp?), and was really rude and thuggish. He kept trying to get me to give him my date of birth and social security number, which there was no way I was doing for some stranger who called asking for it about a debt I never heard of. He wouldn't even give me the last four digits of what he *thought* my SS# or birthday was, which makes me think he doesn't even have it. This is a pretty dumb scam they're trying to pull, but I'm sure some people fall for it.
When I asked him for a mailing address, he claimed it was P.O. Box 9004 Renton, WA 98057. I asked him if that was where I should send a "cease and desist" letter if they kept harrassing me, and he said "you can send whatever you want". Clearly these people have long history of pulling this kind of crap and are prepared for any answer.
If they call again, I'm going to ask them to contact my lawyer instead of me from now on. If they were a legitimate collection company just making a mistake, they would be more knowledable and professional. These people are thugs trying to make a quick buck, and they don't care how they do it.
Whaever you do, don't give them any information.

if your name isn't on the letter, than they think that person lives there. if it isn't you they want, then why are you arguing with them? these companies are prohibited from disclosing information to third parties, so they apparently think the named person lives at your address. tell the company they aren't there, or send the letters back unopened! why are you opening letters not addressed to you anyway? mark them "sender unknown" and put in the mail box.

I have spoken w/several people at ER solutions to explain the fact that I have lost my job...they have continuously called me over and over again, and now are harrassing my parents for payment! these people are absolutely ridiculous! Well first thing you need to do is send them a debt validation letter (you can find a good template in the first link in my signature) If the letter template doesn't have it also include that you only want to deal with them via US postal service. Until they can validate the debt they must cease all collection activity. Also it is illegal for them to disclose information about your debt to anyone but you, a attorney, or another debt collection agency if they intend to sell or transfer management of the account. Just for contacting your parents about the debt you could sue them for $1,000 in statutory damages for violation of the fdcpa (Fair Debt Collection Practices Act) in addition once they receive that letter you can also hold them for $1k per call if they contact you by phone afterwards. Lastly you'll need to send that debt validation letter certified mail, return receipt requested.

diagnosed w/ mets to bone and liver. I've heard there may be foot and hand pain? Also I have alot of pain in back and chest. Currently on Herceptin, Avastin. Arimidex, Flasodex and Zomeda. Now just started the xoleda tonight. Already in alot of pain so I'm anxious about what to expect. Any feedback would be greatly appreciated. i am receiving threatening phone calls from a real rude jerk about a bill my ex was to pay back in 1995..13 years ago....is there a time limit that they can come after you and how do you go about refuting the bill that your ex ran up and her name is on it even though her name is wrong
Some General Comments
First,
Anytime "Acceptance" appears in a companies name, it is probably a debt buyer. This means you may not be familiar with them. I believe Asset Acceptance is big into purchasing debt from fitness clubs (Bally's, 24-Hour, etc).
Second,
If Asset couldnt find or collect from you they would have placed it with an agency or, the 2nd company you would not be familiar with.
Third,
If it isnt your name on the envelope/letter, you commited a Federal crime by opening somebody else's mail, even if it was sent to your address.
And for the individual who said he thinks he was garnished illegally, you couldnt have been. Once the judgment is awarded, you owe the debt even if you had a valid disupte. If you have a valid dispute and they still got a judgment it probably means you didnt take the time to respond to the complaint or show up in court.

i would encourage anyone who ER Solutions contacts to send a debt validation letter. They collected on me for HSBC while HSBC was still billing me! I still do not know why they were billing me but after sending the letter they stopped.
