Bank account garnished


I had a credit card a few years ago and I never paid it off so it went to my credit and 2 years ago I paid all my debts off at once and when I did I contacted evrybody making sure they all got paid and they all did but 1 which is CAPITAL ONE I paid them and thier saying they never recieved my check well I got the check faxed from my bank showing capital one cashed the check and 've been dealing with thier lawyers for about a year and a half I faxed them the check and some how they still sued me and got a garnishment on my bank account, I have called them like 50 times since Friday and thier always not in it is Kramer and Frank PC in st louis, can I sue them for this since I still have the check showing i paid Capital One the only problem is now I have no money for a lawyer since they stole my money. I think these lawyers and Capital One is thieves and the dam bank for letting someone in my account to do this, I also was never notified about being sued.

You have all the documents which shows that you have paid every creditor. Further your bank account is also showing that Capital One has cashed your check. Please collect a photocopy of that statement fron the bank and get it ???Certified to be true copy' stamp from the concerned authority. After collecting all the documents lodge a complain in FTC (Federal Trade Commission). They will take necessary action against Capital One. In addition the creditor should give you a notice as well as the court order that they are going to garnish your wages. Unless and until a court order has been passed they cannot garnish your wages. Ask them to produce the court order. As you are not notified about you being sued and the bank also allowed Capital One to collect money from your account with your approval you can sue the bank also. Lodge a complain in various Consumer Courts. As you do not have the money to appoint a lawyer you can register yourself in a debt consolidation company to get a free counseling. This site offers free counseling to persons suffering from any type of debt related problems. You can fill up the signup form and a debt consultant of your locality will get in touch with you as soon as possible. Please do not stress yourself out.

Welcome to the forums. What is your latest credit report showing about this company CAPITAL ONE?

Apart from taking legal actions against them, you need to work according to the status in your credit report. Make sure that this company has not done any damage in your credit report.
