Well, it depends. Are your payday loans secured or unsecured? This is important in determining your eligibility for this sort of consolidation.

Unsecured means a loan that is not borrowed against collateral like a house or another asset. Secured means that the loan is borrowed against collateral or an asset.

So first, check what kind of payday loan that you have. This company deals with unsecured loans only.

If you do have a secured loan, you may want to consider a consolidation loan instead. If you have good credit or/and assets for collateral, getting a consolidation loan would be a possible alternative way to consolidate your loans.

In addition, I would like to caution you against using payday loans for the future. These types of loans are known for having high interest rates.

These high interest rates stymie attempts by consumers to pay them back. Maybe that is why you are having difficulty repaying this one.

So, next time, try to budget more and use cash more. In addition, save for any additional items you may need. Because avoiding these payday loans will serve to keep your credit out of trouble if you ever have to face a situation when you cannot repay them.

i received a payday loan in october. I was making small payment due to fact that I was working a job that was only temporary for the time being. So I ended up being unemployed and was not able to make those small payments because I was getting unemployment enough to pay rent, electric, and sometimes car note. So I thought the collection agency satisfied the debt owe because I never received no calls nor letters about the outstanding debt until last month in june 2005 a collector called me stating how much i owe and need to take care of the debt asap, and if i do not my wages will be garnished. So I returned the call back to the collector to find out if I can settle this on a month to month payment plan. Of course there was not comprising at all either the full amt or nothing at all. So I asked the collector why I did not receive any phone calls or letters about the debt. He told me that my acct was with another collection agency and they just received it because they been holding on this acct for 1yr and 6mos. He said well its not our fault or your fault that is matter took so long to be resolved. Now since I have your file we need to accept at least 1/4 of the debt which the collector wanted me to pay within a couple of says after contacting me. I told the collector there is no way I can pay that amt at the end of june due to other important bills that are due. As of today the collector never called back because I told him if you would like to contact me do it by written consent because i employer does not allow calls from third parties representatives.

Hi rkhwilliams

Welcome to the forums. I appreciate that you were able to answer the collection agent quite tactfully. But make sure that when they call you next time, you need to ask them to validate your debt. It is fine at their end that they are presently holding your account, but they need to produce you the details of all your transactions which will include the following:

  • They need to show the details of the account.

  • All the calculation has to be shown properly on the amount that is owed.

  • Any copies of the papers to be furnished that shows the payment agreement.

  • They should provide you a verification or copy of any judgment (if applicable)

  • The collection agency should show the original creditor in your debt.

  • The Statute of Limitation needs to be proven for the collection of the debt.

  • The license of the collection agency applicable in the state is to be furnished along with the license numbers and Registered Agent

  • Proof of the agreement that the debt collector has purchased the debt or has been hired by the creditor to collect the debt from the debtor as this is the basic contract law.

  • Complete payment history showing the details of the creditors, payment history, amount of the debt, break up of fees/interest should be provided in paper.

  • A copy of the original signed loan agreement between the debtor and the original creditor establishing the debt between both the parties also has to be produced.

If they are not able to produce the following details, then they can't collect the debt legally from you. Please do not start paying over anything which they claim from you without putting it on paper legally.

Also, if you express that you are willing to pay your past debt after validation, they won't take this matter to the court. They are only forced to take the matter to the court if they don't receive a minimum proportion of the debt from you.

So, be straight and confident while interacting with the collection agent next time. Please do not get intimidated as they will try to bully you if they find you nervous.

Take care and let us know if you face any problem in the meanwhile.

Regards
Roxette
