Can wages be attached by a credit card company?

Welcome to the forums. Wages can be garnished by the credit card company after the Social security, Federal and State taxes have been deducted. The creditor needs to send you a notice of judgment before garnishing your wages. It is necessary in legal terms to send a notice before they can actually do so.

However, your wages cannot be garnished only in certain cases like the following:

  • If your disposable income is less than $170 per week, your garnishment is exempted.

  • If your disposable income is more than $170 per week, then 25% of your wages can only be garnished.

    Wage garnishment is done in the following procedure:

    • Case 1: Suppose your take home pay is $200 a week. Then 25% of your wage will be garnished which will be equal to (25% of $200) = $50 OR

    • Case 2: 40 times of the Federal minimum wage which is 5.15$ per hour i.e. ($5.15 X 40) which is equal to $206. Subtracting $206 from your wage of $200 is $6.)

    The smaller of the two amounts weekly will be garnished unless you have dependent deductions.
