Small Business Credit Cards

I was a manager of a small business,(NOT THE OWNER). I aquired small business credit cards for that business in my name as a way to stay in business. I was laid off a year ago, and the company continued to pay on the cards until 4 months ago when they filed bankruptcy. I now have a Collection agency wanting 10% by tomorrow or they will pursue with legal action. Is there anything I can do?

Hi Dave

Welcome to the forums. The debt collectors are contacting you because they have bought the debt some time ago from the credit card company.

Under the bankruptcy law, as your company has filed for bankruptcy, you will be required to pay your debt since you were paid wages, salaries, or commissions. Each individual employee of a bankrupt business is given a priority of up to $4,650 of the wages they earned up to ninety days before the company filed for bankruptcy.

In order to protect your rights, you should find out the county where the company filed the bankruptcy petition and call the clerk of the United States Bankruptcy Court for that county.
