Hello, I am constantly getting calls from an agency about a bill I owe. Originally it was around $30.00, not it is up to $349.00 with the sure charges of late fees. I get a call every other day, and on a few occassions I have received more then one call a day. I have been told an attachment will be placed on my home. What rights do I have? I have offered them my original amount of $30.00, even 1/3 of the $349.00 I was declined. What can I do now, as I am not in a good financial situation to pay the account off. Thank You

Welcome to the forums. Firstly, debt consolidation program will be helpful to you at this stage as your late fees will be minimized or eliminated after proper negotiations with your creditors. You will be offered a low monthly payment which will be suitable to your present needs and you will be able to pay it of within a stipulated period of time.

You can ask them to validate your debt as you have every right to know the details of it. Further, you can send them a written letter stating your approach regarding payment. I have drafted one letter for you as per your needs.

As a show of good faith I've enclosed my first payment in the amount of $________. If my financial situation improves enough for me to increase my payment amount I will contact you immediately. Thank you for understanding.

Hi Lori

In the previous post Roxette has given you a fair idea about the debt consolidation programme as well as he suggested validating your debts from the creditor.
This is in addition to what Roxette has replied.

You may also lodge a complain against the creditor if they try to harass or threaten you over phone. You should complain to FTC as they handle this type of cases. Further you can also consult a local attorney who will guide you further in this matter. Please make it sure that you should resort to all this if your effort to negotiate with your creditors fails and they carry on harassing you.
