help


collection agency (recovery systems) offer me a settlement told them that I could'nt afford it now said if I didn't pay in 2 days would turn over to lawyers and take me to court. Can they?

Your debts with the collection agency are liable to be prosecuted in the court of law. Recovery Systems also offered you with a settlement plan but you have not accepted the same. In this case the collection agency has every right to take the case to the court if you fail to pay the required amount within 2 days. You can request the collection agency to grant you some more time in order to accept the payment plan. In addition you may start by paying some amount and request the collection agency not to take the case to the court and to accept the amount which you are capable enough to pay, for the time being.

Still if the collection agency adopts unfair means to collect the debt from you then you have every right granted by fdcpa to protect yourself.
