What kind of loan is it? If it is a Direct, Federal, or Guaranteed Loan, she can rehabilitate the defaulted amount for a year of affordable monthly payments. If this is a Perkins Loan, she would be ineligible. Keep me posted.

Ari, I had a Perkins Loan from 93 that I did not know existed, so when I consolidated, it missed it. I was able to work out an arrangement with them to make 12 consecutive payments, and then they would take it out of default.

Is that so? When I collected, it was known that Perkins loans were ineligible for rehabilitation, but the payment plan you described for yours does indeed sound like a rehabilitation. Another thing about collection agencies that contract with the Department of Education is that since they are collecting moneyu for the government, they absolutely must abide the fdcpa through and through. Chris, tell your wife to make sure that the collection agency in charge of her loan is playing ball!
