Wal-Mart sold my debt to NCO Financial Systems.


NCO Financial Systems, which is also GE Consumer Finance apparently. Both names are on the collection statement that was mailed to me. They keep calling saying I need to pay at least 50% of the credit card bill today or they will file a law suit against me. I've offered to make payments to pay it off. If I could do this it will be paid off in 6 months. They refused my offer. Last message on my machine is if I don't call them within 48 hours they will file with the county. How can I get them to take my offer?

I just read NCO is getting sued. Hmmmmmm maybe I can get in on that. Does NCO have to accept my offer of payment? If I don't have the full amount how would taking me to court get them the full amount today? I still can only pay $50.00 a month.

Teresa,

First make sure that NCO has your file from the credit company. They must validate the debt in writing to you within 5 days after placing the first call. NCO has been penalized in the past for their illegal collection activities.

After reviewing the debt account, you can propose a payment plan to NCO. If they are not willing to accept your proposal, you can send your payment through certified mail. If they cash the check, your proposal will be considered as accepted. If they don't, the receipt will prove you were willing to pay the debt.

First thing, get the debt validated in writing from the collection agency. If you have not received anything in the mail, send a debt validation letter through certified mail with return receipt requested and cover your base legally.

Teresa follow Guns and Roses advice... I wish I had this forum when I was going thru this mess. NCO is horrible they also had my wal-mart account they called all the time and even told my little boy they were going to put his mom in jail. They will threaten everything. Taking you to court. Let them. At least the judge will work out a payment plan you can pay. They cant take anything....Credit Card debt is unsecured. I just went thru this. I paid my account off with income tax thank God. Good Luck . KYSIDE38. Listen to the forum they are wonderful......

I expect a call any minute from NCO. I did recieve a letter from them specifying that they were trying to collect a debt from Wal-Mart just the other day. It's $400.00 and I don't deny I owe them the money but I was just shocked by their rudeness and also by them not wanting to help me make payment arrangements. Denise from NCO even said 'It's not very much, only $400, I don't see why you can't pay the whole thing!'
