Weltman Weinberg Reis Co., LPA : Who are they?
Sometimes when they call they claim I have to pay it all off at once other times they are willing to take payments. I made a $50 payment the first time then after they I was making $75 payments I have tried to go back to making $50 payments which are easier with my pay.

Is this collection agency hired by your credit company? You can send your payments directly to the creditors without dealing with the CA. Call them and explain your problems with the CA. Offer some money in advance to make your proposal stronger.
Also, request for the latest statement of your account so that you are sure of your payments getting transferred and the balance amount owed.

They are attorney's office that does 3rd party collections. Send them a letter asking them to only contact you in writing.

Fedup, I dealt with this company and they are one of the worst. They were the ones that told a little boy on the phone that his mom was going to jail. You can read about them on Budd Hibbs Web site. Fortunately I was able to borrow money from the bank and pay these vultures off . Keep me posted on how it goes. KYSIDE38

No doubt in my mind now. They will sue.

TL, I don't know if you are directing this post to me or not??
As of right now, I am unaware of any collection laws WW&R has violated.
Although they phone often, I have not talked with them.
During one of the last phone calls, WW&R left a message that he wanted some information before signing off on my file.

Texas,
I offered them $2000 cash when this first come up, they refused to take it. They want $2800, It is old debt they purchased, so I don't think they paid that much for it. They have been pulling little pranks through out this whole process, offering me payment plans, then stating they don't offer payment plans, it is like the right hand don't know what the left hand is doing half the time. I am still waiting on a letter of activity from the original creditor to determine if this debt is out of SOL or not, they have not returned my request. So I am sending it certified next week.

Thanks for the reply Cajun.
I assume you're referring to the guest on this thread.
I am no longer a guest as I just signed up on the board.
Unfortunately, I, like many people have opted to push my CA problems under the rug.
I have answered no phone calls from WW&R and have kept no correspondence from them.
It has been two years since my last payment to the original creditor - Providian/now sold out to Washington Mutual.
The SOL in my state is four years so I am aware if they are going to sue, it will be soon. At this point, I am getting nervous.
Especially since I have found out WW&R is also a legal firm.
I have not asked them to validate.
At this point, should I take this step now?
Any advise will be very much appreciated.

I currently have a past Sears account with WW&R and I have never been threatened and they have been more than happy to work with me.
There was a time when I went for a long time by not hearing from them or doing any correspondance, until they finally called me and real calmly and professionally, but stil with a "sense of urgency" tone, said we need to get this taken care of soon. I guess if you work with them nicely, they'll work with you nicely, but it also depends on the representative you work with.
Heck, they have been the only CA to accept my 3rd party debt management program!

My wife received a phone call from WWR and they told her that we neeeded to pay this debt from Fleet Bank. She got scared and called me and told me to call them. First mistake. I called and they explained to me that this account was sold to Lvnv funding and then to resurgent capital and now WWR is representing resurgent capital. I have asked when the account was opened 1997 and when the charge off date was (they will not give me the charge off date). I have asked WWR for all documentation pertaining to this account and they faxed me a single page with a single payment of $100.00 paid to an attorney (Richard Boudreau (Alegis and sherman financial) on Oct 30, 2004. I have not been contacted by anyone pertaining to this account since that date. I thought I had paid this off, but I can not find documentation of it. Mistake number two. I spoke to WWR and they offered me 70% then 60% and then finally 50% settlement. I told them I would have to talk to my bank first. This was on June 28, 2007 and I told the rep. that it would be at least July 5 or 6, 2007 before I could get anything done at the bank. My wife then gets a fax from WWR and it states that a settlement authorization has been sent to my financial institution and the due date is June 29, 2007. I called my bank and told them to not issue a check to these people. This is a small town bank that I have used for years and they were not going to do it until they talked to me regardless. I did not have the funds available and would have to get a loan to pay it also. I called WWR and told them that we never had an agreement to settle for June 29, 2007. I told them myself and another rep. had discussed it, but it would not be able to get completed until July 5 or 6, 2007. This rep. claimed that he has a bounced check from me and he wanted to know how I was going to take care of it and the account. I told him I wasn't. I have never received any written documentation from WWR stating I owed a debt or this is an attempt to recover a debt. I have been reading online about these steps and I see they may have missed one. I would love to have some helpful advice on how to deal with this situation.

Guest, first of all, what state are you in? It may be past the SOL. Don't pay them anything until you get a full debt validation. I sent them a second request for DV, stating they did not fully validate. Don't give them any bank info-if you decide to settle, have it in writing. I didn't do this, and now they want the full amount. They will also refuse to give you a letter regarding settlement. After they speak with you, I believe, they have 5 days to contact you via mail stating they are attempting to collect a debt. They will threaten and try to scare you into paying before the validation, so be carefull. Keep us posted..KAren :D
DEVILS ADVOCATE
1. PAYMENT OPTIONS WILL DEPEND ON PERSON THAT YOU SPEAK TO, THERE IS NO REAL STANDARD WHEN IT COMES TO PAYING BACK THE DEBT.
2. CA LAW FIRMS WORK BASICALLY LIKE THIS...YOU OWE A DEBT TO THE ORIG CRED, IF CHARGED OFF A 3RD PARTY CAN BUY IT, SO ON AT SOME POINT IF 3RD PARTY CHOOSES TO CAN FORWARD TO LAW FIRM TO COLLECT BALANCE IN FULL OR SETTLE THROUGH AGREED ARRANGEMENT, AND IN WORSE CASE SCENERIO WAGE GARN, LEIN ETC. THE FIRM DOES NOT OWN THE DEBT THE 3RD PARTY DOES, 3RD PARTY IS CLIENT OF FIRM.
3. AS IN ALL CASES BEST ADVICE IS TO JUST COMMUNICATE I HAD DEALINGS WITH WWR AND IN SOME CASES IT WAS NOT VALID MADE THEIR JOB EASIER AND I STOPPED GETTING CALLS..A WIN WIN! PEOPLE GET NEW NUMBERS ITS A FACT OF LIFE PEOPLE GO IN DEBT PEOPLE TRY TO COLLECT THAT DEBT NO NEED TO GET UPSET WHEN SOMEONE CALLS FOR SOMEONE ELSE ITS EASIER TO JUST SAY IM SORRY YOU HAVE THE WRONG NUMBER THAN IGNORE IT AND CONTINUE TO GET CALLS EVERYDAY AND THEN BE ANGRY ABOUT IT!
4. AS IN A LOT OF THINGS IN OUR LIFE THINGS ARE AUTOMATED SO WHEN YOU SAY CALL BACK AT THE END OF THE MONTH IT CAN BE HARD TO TELL A COMPUTER THAT, THINK ABOUT YOUR JOB AND HOW THINGS DONT ALWAYS WORK OUT THE WAY THE SHOULD

I had problems with them too. Sent them the DV letter back in July and got no reply. Then I found out a couple months ago they tried suing me using an old address I haven't lived at in 6 years (the summons was returned to the courthouse as undeliverable as the address no longer exists)
Capital One
They are working on suing me for an account I had with cap 1,
I have been laid off 3 times in the past year. They don't want to set up a payment plan want it in full, I'm not willing to pay all of those late fees and int charges, I will be going to court. Has anyone faced them in court?

People, the first thing you need to do is NOT acknowledge any debt. All debt is ALLEDGED until proven. Next, you need to send them a Demand for Validation and Verification of Debt. Next, you need to make them prove that they have the legal authority to be doing anything in your state (are they licensed there)?
It does not matter if they are attorney's or not. They still have to abide by the law and they do not, but get by with it because they scare people.
You need to be informed and know your rights! Also, if it is old debt, check the Statute of Limitations in your state. If it is past the statute of limitations, then WW&R are SOL!!!!!!!

It appears they sue when there is substantial money involved. I've received numerous calls to cell without contact, then a letter arrived with no info, just an amount, now a couple of calls to house. These junk debt buyers hide behind their attorney status to intimidate people, which sounds like its working. I'm going to wait it out a while, seems I'm close to SOL. They indicate we owe Collect America for an old HSBC credit card. It's almost 5 years old and neither has ever contacted us before and hasn't posted on CR. I'm going to check reports now tho to see how serious they may be. Good luck to all in their serious times.

Make sure all of you that are dealing with WW&R are getting your debt taken care of. The are a Law Firm and they will sue you. Trust me! When they call don't get upset just calmly talk to them and most of the collectors working there will try to help you out.

Summons was placed in mailbox today, after server was told I was not available. The summons was refused but "server" left it with mail. Apparently Weltman, Weinberg & Reis are suing me for Capital One. I owed almost $700.00 Oct. 2006. Now they say it's over $3,300. What can I do? I wouldn't mind making monthly payments.

You need to read up on Electing Arbitration. Cap1 cardholder agreements allow you to elect arbitration and waive them outta court. It sounds complicated but it's not. Spend a few hours doing some research. Try forums at creditinfocenterdotcom and take a look at ccarbitrationdotcom. That explains how the creditcard companies have basically screwed themselves by trying to screw the consumer. A summary of the situation is: You elect arbitration through JAMS. Cap1 has already generously agreed in their contract to pay all Arbitration fees, win or lose, and they also state each side pays their own atty fees. They will get billed somewhere around 800 once the paper work gets filed, then shortly thereafter another 2000, with more to come. They can't recover those costs. Nobody is gonna spend 5K-10K to maybe collect 3K...Read up on it until you understand how it works...You'll need to answer the complaint and get your arbitration demands in....the other sites will fill in any other questions you may encounter...best regards maggie22
